| Rubble piles, particularly those in proximity to ponds and wetland features are frequently used as resting places by great crested newts, amphibians and other reptiles. Great Crested Newts (GCNs), their eggs, breeding sites and resting places are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2017 (as amended), the latter of which deems them a European Protected Species. It is a criminal offence to deliberately damage or destroy their resting places, to deliberately kill or injure a GCN, disturb a GCN in its resting place or obstructing their access to breeding or resting locations. Planning consent for a development does not provide a defence against prosecution under these acts. To avoid harm to GCNs, as well as other common amphibians or reptiles which may be using the site, it is recommended the following measures are adhered to throughout the course of the construction works: 1) Clearance of any rubble, logs, bricks, other loose materials or other potential refuges will be done by hand, during the active season for amphibians and reptiles (March to October) when the weather is warm enough to allow animals to disperse naturally; 2) Grassy areas will be kept short prior to and during the construction period to avoid creating attractive habitats for wildlife; 3) All building materials to be used, moved or disposed of including: rubble, bricks and soil must be stored on raised platforms (e.g. wooden pallets) to prevent their use as refuges by wildlife. Any trenches left overnight will be covered or provided with ramps to prevent animals falling into the trenches and being trapped. Excavations left overnight should be checked prior to filling. Any open pipes left overnight must be suitably capped; 4) All works must take place during daylight. |
