| Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.
Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan. |
| The development hereby permitted shall not be occupied/first used until full details of all surface water drainage systems to serve the evelopment have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be
implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter.
Reason: To ensure development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan. |
| No development shall take place until an Ecological Mitigation, Compensation and Enhancement Scheme prepared by a suitably qualified and licensed ecologist is submitted to, and approved in writing by, the Local Planning Authority or varied by a bat licence subsequently issued by Natural England. The scheme shall be based on recommendations set out in the Preliminary Ecological Appraisal and Preliminary Roost Assessment report, dated September 2024 and the Bat Emergence and Re-entry Survey report, dated May 2025, both carried out by Arbtech; and the Bat Mitigation Strategy, dated June 2025 and Great Crested Newt Assessment, dated August 2025, both carried out by CTM Wildlife Ltd., and shall include an implementation timetable. The works shall thereafter be carried out in accordance with the approved details and timetable.
On completion of the works, the development shall be inspected by a qualified ecologist and a statement of conformity and a copy of any bat licences and licence monitoring returns as appropriate shall be submitted to the Local Planning Authority to confirm the mitigation and enhancement measures for biodiversity have been successfully implemented in accordance with the details approved under this condition.
Reason – To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policies SWDP22 and SWDPR27 of the South Worcestershire Development Plan, paragraphs 187 and193 of the National Planning Policy Framework and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017). |
| Prior to the commencement of development, a Lighting Design Strategy for Biodiversity shall be submitted to and approved in writing by the Local Planning. The strategy shall be based on Guidance Note 08/23. Bats and Artificial Lighting at Night, by the Bat Conservation Trust and ILP, and shall include the following:
a) Identification of the areas/features on site that are particularly sensitive for nocturnal wildlife and that are likely to cause disturbance in or around their breeding sites and resting places, or along important routes used to access key areas of their territory, for example, for foraging; and
b) Show how and where external and internal lighting will be installed (through the provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent bats and other nocturnal wildlife from using their territory or having access to their breeding sites and resting places. This will include the provision of dark corridor conditions (LUX levels at or below 0.4 in the vertical plane and 0.2 LUX in the horizontal plane) for retained trees, steam corridor, woodland edge, hedgerows, and commuting routes for bats.
All external lighting shall be installed in accordance with the specifications and locations set out in the strategy and these shall be maintained thereafter in strict accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority.
Reason – To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policies SWDP22 and SWDPR27 of the South Worcestershire Development Plan, paragraphs 187,193 and 198 of the National Planning Policy Framework and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017). |
| The development hereby permitted shall be carried out in accordance with the details provided in the Arboricultural Survey BS5837:2012 by arbtech.
Reason: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and policies MD1 and MD2 of the Malvern Town Neighbourhood Plan. |
| Prior to first occupation of the dwelling herby approved, details to demonstrate that the predicted non recycled water consumption of the property will be no more than 110 litres per day per person shall be submitted in writing to the Local Planning Authority for approval.
Reason: To mitigate the impacts of climate change in accordance with policy SWDP30 of the South Worcestershire Development Plan.

| a) The PROW is to be incorporated into all the development plans to ensure public safety by making developers and contractors aware of its location.
b) There must be no reduction in the available width of the public right of way, no planting should interfere with the surface of or restrict passage along the public right of way.
c) Vehicle movements and parking must be managed to avoid unreasonable interference with the public’s use of the PROW.
d) Any change in the surface of the PROW must be approved by the Highway Authority and any damage to the surface caused by construction must be restored to the original condition or a specification agreed with this department.
Reason - To ensure the public right of way is not impacted by the development. |
| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
