Condition Details / Information Notes
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information provided on the application form and documents submitted, and the following plans: Site Layout – CO-PD-001BC (Colour Site Layout) Materials Layout - CO-PD-020C (Materials Layout) Means of Enclosure - CO-PD-060C (Means of Enclosure) Site Layout - CO-SL-001M (Site Layout) Parking Plan - CO-SL-050B (Parking Plan) Street Scenes - CO-PD-060A (Street Scenes) Landscape Plans – GL2439 LP 01A (Sheet 1 of 2) ; GL2439 LP 02A (Sheet 2 of 2) House Type Pack - Martley House Pack 10.07.2025 Reason: To define the permission.
The footpath surface shall be finished in tarmac, as is seen in the Lion Court development that is to the south of the Martley Playing field and recreation ground. Reason: For the avoidance of any doubt.
The applicant is reminded of the need to have secured and completed the legal diversion order to re-route the public right of way.
Please also take note of the general obligations to Public Rights of Way: • The Public safety of those using the right of way must be ensured at all times. • There must be no diminution in the width of the rights of way available for use by the public. • There must be no change to the surface of a Public Right of Way without written consent from the authority. • Building materials must not be stored on the rights of way. • Vehicle movements and parking are to be arranged so as not to unreasonably interfere with the public’s use of the rights of way. • No additional barriers are to be placed across the rights of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority.
Where possible, the definitive line of public rights of way should be kept open and available for use throughout the construction phase. However, if Public Safety demands a temporary closure, application should be made at least 8 weeks in advance to: The Public Rights of Way Mapping Team at prowclosures@worcestershire.gov.uk. Obstructing a Public Right of Way without a formal closure constitutes an offence under the Highways Act 1980.
The applicant should be aware that, under section 34 of the Road Traffic Act 1988, any person who, without lawful authority, drives a motor vehicle on a public right of way commits an offence. The applicant should make themselves satisfied that they, and anyone else who may use public rights of way for private vehicular access in connection with the development, has a right to do so. They may wish to seek legal advice on the matter. The County Council is responsible for maintaining rights of way to a standard suitable for their public use.
