Condition Details / Information Notes
Due to the size of the curtilage of the dwellings as proposed, in comparison to the land area occupied by the building, it fails to comply with the definition of ‘curtilage’ as set out within Paragraph Q3 (1) of Schedule 2, Part 3 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). As such, it is considered that the proposed change of use does not constitute permitted development under Class Q of Schedule 2, Part 3 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
The proposal would have a detrimental impact on highway and pedestrian safety due to the absence of a suitable access, failing to allow for two-way vehicle movements, and failing to comply with Paragraph Q1 (p) to Class Q of Schedule 2, Part 3 of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). The substandard width of the access would result in the need for drivers to reverse their vehicles towards the highway or towards the existing farmyard. The proposal is therefore contrary to Policy SWDP 21 of the South Worcestershire Development Plan (2016) and paragraph 115 of the National Planning Policy Framework.
The type and amount of commercial activity within close proximity to the proposed residential dwellings, in conjunction with agricultural activities, would be likely to result in future occupiers being detrimentally impacted by way of noise and disturbance, as has been the case with existing occupants of residential properties neighbouring the site, contrary to Policies SWDP21 and SWDP31 of the South Worcestershire Development Plan 2016.
The proposed amount and style of glazing, in conjunction with the removal of a central section of the building creating a link-detached effect of the two dwellings, would result in the application building losing its agricultural character and failing to sit comfortably within its setting. As such, the proposed development would be incongruous and out of keeping with the surrounding rural character of the area, contrary to Policy SWDP21 and SWDP25 of the South Worcestershire Development Plan 2016.
