The building’s curtilage as shown on the submitted plans fails to comply with the definition of ‘curtilage’ as set out within paragraph Q.3(1) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). In light of this, it is considered that the proposed development does not constitute permitted development as per Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
The application fails to comply with paragraph Q.1(g) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) as development under Class A(a) of Part 6 of Schedule 2 has been carried out twice, on the established agricultural unit during the period which is 10 years before the date development under Class Q begins. In light of this, it is considered that the proposed development does not constitute permitted development as per Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
Insufficient information has been provided in order for the local planning authority to establish whether the proposed development complies with Paragraph Q.1(j)(i) and (ii) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) and to determine whether the prior approval of the authority is required as to the design or external appearance of the building, contrary to Paragraph Q.2(1)(f) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
Insufficient information has been provided in order for the local planning authority to establish whether the proposed development, in relation to proposed dwellings 1, 2, 6 and 7, is capable of complying with the nationally described space standard as set out within Paragraph Q.1(o) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
Due to the restrictions placed on the size of curtilage space by the General Permitted Development Order, and from reviewing the application site, it is considered that there would not be sufficient space within an application boundary which satisfies the curtilage requirements of the General Permitted Development Order, in order to allow for the required number of vehicle parking spaces to be provided. This would result in the obstructive and inappropriate parking of vehicles at the site access and/or on the public highway, which would interrupt the free flow of traffic and prejudice the safety of road users. This would represent an unacceptable transport and highways impact contrary to Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan (2016) and Chapter 9 of the National Planning Policy Framework.
Insufficient information has been provided in order for the local planning authority to determine whether the prior approval of the authority is required as to the provision of adequate natural light in all habitable rooms of the dwellinghouses, contrary to Paragraph Q.2(1)(g) of Schedule 2, Part 3, Class Q of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
