| The proposed enlargement of the dwellinghouse by the construction of an additional two storeys does not comply with the criterion of Class AA due to the applicant failing to provide sufficient information to enable the authority to establish whether the proposed development would comply with the conditions, limitations or restrictions of Class AA as specified in paragraphs AA.1 and AA.2. The applicants supporting statement is considered to fail to provide sufficient evidence to demonstrate when the dwellinghouse was constructed. Based on the OS Epoch maps and planning history relating to this site, it would appear that the dwelling was created through part demolition and extension of an existing public house in situ circa 1843. As such, it cannot be determined that the proposal accords with all parts of paragraph AA.1 and in particular criterion (e) of Schedule 2, Part 1, Class AA of the Town and Country (General Permitted Development) (England) Order 2015 (as amended). |
| The development proposed would not be permitted development under condition AA.2 sub paragraph (3) part (a) (ii) (aa) of Class AA of Part 1, Schedule 2 of the (General Permitted Development) (England) Order 2015, as amended. The Council find the proposal to represent a poor design, which would create an unbalanced and disproportionate dwelling that would be incongruous and harmful to the original character and appearance of the principal elevation of the main dwelling and fail to reinforce its local distinctiveness within the rural landscape. In addition, the applicant has failed to submit any evidence such as Ecological Appraisal to provide an accurate account of protect species being presence within the site and surrounding landscape, the potential of them being impacted by the proposal, and the extent of the likely impact as a result of the proposed development. It is not considered that any public benefits would outweigh the harm as a result of this proposal. |

| In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately, the submitted application is not considered to accord with policy. As a result, the Council has been unable to seek solutions to problems arising from this application as the amendments and additional information required to make the application acceptable are substantial and would be required to be submitted as a new planning application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application |
