Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: - MF11 Rev. G - MF12 Rev. D - MF14 Rev. F - MF23 Rev. A Reason: To define the permission.
Unless otherwise agreed in writing with the Local Planning Authority, the development shall be carried out using Blockleys Heritage Wire-cut bricks and Kingspan KS 1000 in Anthracite Grey for the roof and upper gables. Reason: To ensure that the new materials are in keeping with the surroundings in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.
The Development hereby approved shall not be brought into use until the access, parking and turning facilities have been provided as shown on drawing MF/11'G'. Reason: To ensure conformity with submitted details, in the interests of highways safety and in accordance with policy SWDP21 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in accordance with the boundary details as shown on DWG No. MF/14'F' and completed before the first use of the development hereby permitted. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development hereby approved shall be carried out in accordance with biodiversity enhancement measures within the Europeus Land Management Services Report dated November 2017 as approved in the conditions decision letter for 17/01650/FUL dated 01.08.2019, native tree and shrub planting as shown on DWG No. MF/14 'F' and the specification for soft landscaping works Revision B as approved under planning consent 19/00418/FUL. The approved works, shall be carried out in accordance with the approved programme of implementation. Reason: To enhance biodiversity on accordance with Policy SWDP 22 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in accordance with the scheme of landscaping as shown on DWG No. MF/14'F' and specification for soft landscaping works Revision B approved under planning consent 19/00418/FUL. All planting and seeding shall be carried out in accordance with the approved details in the first planting season following the completion or first use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development shall be implemented in accordance with the alternative method of surface water disposal as shown on DWG No. MF/14'F' and detailed within the submitted Water Management Statement prior to the first use of the development. Reason: To ensure that the site can be adequately drained in accordance with Policy SWDP 29 of the South Worcestershire Development Plan.
The development hereby permitted shall be implemented in accordance with the measures set out in the Water Management Statement before the development is first brought into use and retained thereafter. Reason: To ensure water management is taken into account in the development in accordance with SWDP 30 of the South Worcestershire Development Plan.
The development hereby permitted shall be implemented in accordance with the Phase I Environmental Assessment Report for Oracle Environmental Experts dated 20.07.2018 and the Phase II Intrusive Investigation Report by Oracle ref, P18/526/P11 dated July 2019 as approved in the conditions decision letter for 17/01650/FUL dated 01.08.2019. In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where necessary a remediation scheme must be prepared, these will be subject to the approval of the Local Planning Authority. Following the completion of any measures identified in the approved remediation scheme a validation report must be prepared, which is subject to the approval in writing of the Local Planning Authority prior to the occupation of any buildings. Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, in accordance with Policy SWDP 31 of the South Worcestershire Development Plan.
Prior to installation, details of broadband provision shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is first brought into use and retained thereafter. Reason: To ensure that the development is provided with adequate broadband provision in accordance with Policies SWDP26 of the South Worcestershire Development Plan.
The development shall be implemented in accordance with the Energy Statement by Stanton King Associates Ltd, BRUKL Output document and BRegs Part 2A Design Assessment information as approved in the conditions decision letter for 17/01650/FUL dated 01.08.2019. The approved details shall be implemented in accordance with a timetable to be approved in writing by the Local Planning Authority and retained thereafter. Reason: To ensure sustainability measures are taken into account in the development in accordance with Policies SWDP21 and SWDP27 of the South Worcestershire Development Plan
The attention of the applicant is drawn to the need to keep the highway free from any mud or other material emanating from the application site or any works pertaining thereto.
This permission does not authorise the laying of private apparatus within the confines of the public highway. The applicant should apply to the Worcestershire County Council’s Network Control Manager, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), for consent under the New Roads and Streetworks Act 1991 to install private apparatus within the confines of the public highway. Precise details of all works within the public highway must be agreed on site with the Highway Authority.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; and considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The applicant must be aware of their obligations towards the public right of way as follows: No disturbance of, or change to, the surface of the path or part thereof should be carried out without written consent (this includes laying concrete, tarmac or similar) No diminution in the width of the right of way available for use by the public. Building materials must not be stored on the right of way. Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public's use of the right of way. No additional barriers are placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority. The safety of the public using the right of way is to be ensured at all times.
Any proposals to alter existing, or construct new, culverts or carry out works in or on an ordinary watercourse will need Land Drainage Consent under s.23; Land Drainage Act 1991 from SWLDP. Such consent will need to be granted prior to any works commencing on site as consent cannot be granted retrospectively. Failure to comply may result in enforcement action being taken by the Lead Local Flood Authority, Worcestershire County Council, under the Act. SWLDP may also exercise powers to require works for maintaining flow of a watercourse where appropriate under s.25 of the Act where the proper flow of water is impeded.
