Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission 21/00732/HP, dated 8 October 2021. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans. Approved Plan Numbers: LOCATION PLAN Drawing Number 001 Rev 01 PROPOSED SITE PLAN Drawing Number 101 Rev 04 PROPOSED FLOOR PLAN – MAIN HOUSE Drawing Number 104 Rev 05 PROPOSED – GARAGE/WORKSHOP CONVERSION Drawing Number 105 Rev 07 PROPOSED ELEVATIONS – MAIN HOUSE Drawing Number 202 Rev 06 PROPOSED ELEVATIONS – WORKSHOP Drawing Number 203 Rev 07 Reason: To define the permission.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the material details as provided on drawing no. 203 rev 07 Proposed Elevation - Workshop, drawing no. 202 rev 06 Proposed Elevations - Main House, and the document entitled Varied Conditions & Material Choice V1.0 and supporting photographs. Reason - To ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.
Prior to the first use of the annex hereby approved, a plan showing the blocking up of the access from Watery Lane, shall be submitted to and approved in writing by the Local Planning Authority. The approved details shall be implemented in full and thereafter retained as such. Reason: To protect the amenity of the surrounding area in accordance with SWDP21.
The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as 144 Upper Welland Road and shall not be used as an independent self contained dwelling separate from the dwelling known as 144 Upper Welland Road. Reason: To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan.
Prior to the first occupation of any dwelling hereby approved, space shall be laid out within the curtilage of the property that is the subject of this permission for 3 cars to be parked and for a vehicle to turn so that it may enter and leave the application site in a forward gear. The parking area shall be properly consolidated, surfaced and drained in accordance with details to be submitted to and approved in writing by the Local Planning Authority and that area shall not thereafter be used for any other purpose than the parking of vehicles. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal Report carried out by Andrew Tillson-Willis dated June 2021 and submitted with this application. In particular: - The removal of two short laurel hedgerows should be conducted outside of bird nesting season (April to August inclusive). If clearance is to take place inside bird nesting season, a pre-clearance search by a suitably experienced ecologist/ornithologist will be required. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the biodiversity enhancement measures as set out in the submitted Proposed Site Plan, Drawing Number 101 Rev 05, and shall remain thereafter. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible. However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts.
Buildings are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the 1981 Wildlife and Countryside Act and the Habitat Regulations 1994, the latter of which deems them a European Protected Species. It is a criminal offence to recklessly disturb or destroy a bat 'roost'. Where a bat 'roost' is present a licence might be necessary to carry out the works. Further information about species licensing and legislation can be obtained from the Species Licensing Service on 0117 3728000. If evidence of bats is found during works, work should stop immediately and Natural England must be contacted on 01453 764450 for advice on the best way to proceed.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
