Condition Details / Information Notes
The proposed extension and relocation of the external staircase would, by reason of their proximity to The Coach House, result in increased overlooking, loss of privacy and loss of outlook to that property and consequential harm to the residential amenity presently enjoyed by its occupiers. Furthermore, the proposed development would reduce light to the living room of Flat 6 and also interrupt and reduce the light and ventilation presently enjoyed by the bedroom of Flat 6 via its west facing window and reduce light to the bedroom of the adjoining flat to the south, via its north facing window, resulting in an unacceptable and reduced standard of living for the occupiers of those flats and consequential harm to residential amenity. Accordingly, the proposal would be contrary to Policy SWDP21 of the South Worcestershire Development Plan and paragraph 135 of the National Planning Policy Framework.
The proposed extension and staircase, by virtue of the loss of a historic stone wall and mullioned window, would have a detrimental impact upon the significance of the non designated heritage asset (NDHA). Furthermore, the resultant development would encroach upon the courtyard reducing its size and subsequently harming the significance of the building. With regard to paragraph 212 of the NPPF, it is considered the development would result in a level of ‘less than substantial’ harm, and be contrary to policies SWDP6 and SWDP24 of the South Worcestershire Development Plan and paragraphs 203, 205 and 206 of the NPPF and this is not outweighed by the public benefits of the proposal.
In dealing with the application the Council has implemented the requirement in paragraph 398 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately the submitted application is not considered to accord with the advice available nor was pre-application advice sought prior to its submission. As a result the Council has been unable to seek solutions to problems arising from this application as the amendments required to make the application acceptable are substantial and are considered to materially change the development proposals. They would require further consultation to be undertaken prior to determination which could not take place within the statutory determination period specified by the Ministry of Housing, Communities & Local Government. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application
