Condition Details / Information Notes
The scheme would result in the loss of a non-designated heritage asset, which includes an historic shop frontage, and by virtue the size, height, form and contrasting design of the proposed replacement structure, the development would fail to reflect the surrounding area within the Neighbourhood Parade of Link Top, and would visually dominate the streetscene forming an incongruous, harmful and intrusive feature. The development would therefore harmfully detract from the character and setting of the Malvern Trinity Conservation area as well as the setting of the nearest grade II listed buildings, including the Church of the Holy Trinity, the North Malvern War Memorial and no. 102 Worcester Road. The total loss of the non-designated heritage asset, as well as the identified level of ‘less than substantial’ harm to the character and setting of the heritage assets would be significant and would not be outweighed by the benefits of the scheme. As such the development would be contrary to policies SWDP 6, SWDP 21, and SWDP 24 of the South Worcestershire Development Plan (2016), guidance with the Malvern Trinity Conservation Area Appraisal, the Malvern Shop front design guide, policies MD1, MHE1 of the Malvern Town Neighbourhood Plan and Chapter 16 of the National Planning Policy Framework.
The proposed development would result in an adverse loss of natural light to the western windows of neighbouring property 90 and 90A Worcester Road and would also fail to provide adequate standards of suitable private amenity space for the occupants of the development, contrary to policy SWDP21 of the South Worcestershire Development Plan and also contrary to the guidance within the Design Guide SPD and contrary to policy MH2 of the Malvern Town Neighbourhood Plan.
The overall provision of 2 parking spaces to serve 4 residential units falls too far short of the requirement within the “Streetscape Design Guide” for 8 parking spaces and is considered to be inadequate in this instance, likely to lead to on street parking and adverse impacts on highways safety, contrary to policy SWDP 21 of the South Worcestershire Development Plan and also contrary to policy MD1 of the Malvern Town Neighbourhood Plan.
In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately, the submitted application is not considered to accord with policy. As a result, the Council has been unable to seek solutions to problems arising from this application as the amendments and additional information required to make the application acceptable are substantial and would be required to be submitted as a new planning application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice.
