Condition Details / Information Notes
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – RC1, RC2, RC3, RC4, RC5, RC6 ,RC7, C1, C2, C3, C5, C6 and C7. Reason: To define the permission.
Demolition/ground works/construction work shall not take place outside the following hours: Monday to Friday 07.30-18.00 hrs Saturdays 08.00 -13.00hrs. There shall be no such work on Sundays or Public Holidays. Reason: To protect the residential amenities of the area in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order, 2015 (or any Order revoking or re-enacting that Order with or without modification) no additions, extensions or external alterations shall be made to the dwellings hereby approved without the submission and subsequent approval of a separate application for planning permission. Reason: In the interests of the residential amenity of neighbouring properties in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking and re-enacting that Order with or without modification), no building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling houses as such (other than those expressly authorised by this permission) shall take place within the site of the dwellings without the submission and subsequent approval of a separate application for planning permission. Reason: In the interests of the visual amenity of the area in accordance with Policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.
The works shall be carried out in strict accordance with the mitigations/recommendations set out in Section 7 of the Ecological Appraisal dated December 2017 drafted by Envirotech Ecological Consultants and submitted with 18/01536/FUL. Reason: To protect this potential habitat of protected species under the Wildlife and Countryside Act 1981 and in accordance with Policy SWDP22 of the South Worcestershire Development Plan.
The Development hereby approved shall not be occupied until the visibility splays shown on drawing 4144BP-02 Rev 02 (received in 18/01536/FUL) have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. Reason: In the interests of highway safety in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
The development hereby approved shall not be occupied until the first 5.0 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
The development hereby approved shall not be occupied until an area has been laid out within the curtilage of the dwelling for the parking of 2 cars. This area shall thereafter be retained for the purpose of vehicle parking only. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
Prior to the first occupation of the development hereby permitted, the details set out in the submitted Water Management Statement and the site investigation report produced by the Nott Group ref. 73110/R/010 (19/08/21) as submitted in 18/01536/FUL shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP30 of the South Worcestershire Development Plan 2016.
Before the first occupation of the dwelling hereby permitted the first floor en-suite window set in the west side elevation and the first floor bathroom window set in the east side elevation shall be fitted with Pilkington Level 4 obscured glazing or equivalent with opening restricted to no more than 150mm. Further to this, the landing window set in the west side elevation shall be fitted with Pilkington Level 4 obscured glazing or equivalent and permanently fixed shut. The windows shall be permanently retained in that condition thereafter. Reason - To protect the amenities of the adjoining property from unacceptable overlooking/loss of privacy in accordance with policy SWDP21 of the South Worcestershire Development Plan.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Energy Statement (ref: NT1894002) and CD4 Sustainability Measures shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate reduction in energy usage is provided to serve the development in accordance with policy SWDP27 of the South Worcestershire Development Plan 2016.
The new dwelling shall be constructed with the submitted external facing and roofing materials as approved in M/25/00160/CCO. Development shall be carried out in accordance with the approved details in CD2 and CD3. Reason: To ensure that the new materials represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.
The approved broadband details outlined within M/25/00160/CCO shall be implemented in accordance with the details in document CD8 before the development is first brought into use and retained thereafter. Reason: To ensure that the development is provided with adequate broadband provision in accordance with Policy SWDP26 of the South Worcestershire Development Plan.
The new development hereby approved shall be carried out within the approved measures of the CEMP document (September 2021) as submitted by Lockley Homes and accepted in 18/01536/FUL. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
