| The application property comprises a semi-detached dwelling with no additional sound proofing proposed and situated in close proximity to its adjoining and other immediate neighbours. Consequently, it would form an unsuitable host property for the proposed use, by reasons of the significant potential to generate unacceptable noise nuisance, giving rise to disturbance to the occupiers of neighbouring properties. Harm to neighbouring amenity would also arise from the limited off road parking and the pattern of associated vehicle movements to and from the property, and the resultant noise during staff shift changes, particularly late in the evening on a daily basis. Furthermore, the nature and context of the proposed use would generate a perception of harm in the immediate community which would be detrimental to the health and wellbeing of local residents and their quality of life. Accordingly, the proposal would be contrary to Policies SWDP21 and SWDP 31 of the South Worcestershire Development Plan and Paragraph 198 of the NPPF. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
