Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission M/23/01674/HP dated 10 April 2024. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents Location Plan PROPOSED SITE PLAN-A MAD/WAL/23/SITE-1 PROPOSED PLANS & ELEVATIONS MAD/WAL/25/1-1/B LOCATION PLAN MAD/WAL23/LOCATION Reason: To define the permission.
Prior to the first occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
A public right of way crosses the site of this permission. The permission does not authorise the stopping up or diversion of the right of way. The right of way may be stopped up or diverted by Order under Section 257 of the Town and Country Planning Act, 1990, provided that the Order is made before the development is carried out. If the right of way is obstructed before the Order is made, the Order cannot proceed until the obstruction is removed.
Buildings are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the 1981 Wildlife and Countryside Act and the Habitat Regulations 1994, the latter of which deems them a European Protected Species. It is a criminal offence to recklessly disturb or destroy a bat 'roost'. The applicant is advised to take professional advice on the matter since it is possible that a protected species licence might be necessary to undertake these works. Further information about species licensing and legislation can be obtained from the Species Licensing Service on 0117 372 8000. If evidence of bats is found during works, work should stop immediately and Natural England must be contacted on 01453 764450 for advice on the best way to proceed.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
