| The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: 01b Location Plan 05b Block Plan 06b Plans and Elevations 07b Site Layout Plan. Reason: To define the permission. |
| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
| Any external artificial light to be installed will adhere to the following best practice specifications: • Located in areas for safe access only; • Only include downlighting; • No additional artificial light spill on the mature walnut (T1), hedgerows or brook; • Have the lowest viable low lux value; and • Have a K value of less than 2700K. Reason: Given its rural location and in the interests of biodoversity, to reduce light spillage and pollution, further to policies SWDP 21, SWDP 22 and SWDP 25. |
| No development shall take place (including any ground works, demolition or clearance) until a construction environmental management plan (CEMP: Biodiversity) has been submitted to and approved in writing by the local planning authority. The CEMP (Biodiversity) shall be informed by updated ecological survey and include the following: - If a protected species such as but not limited those detailed in section 5 of this report or evidence of a protected species is discovered all work must stop immediately. An appropriate avoidance or mitigation strategy will be agreed with a suitably qualified ecologist before works can continue. - If significant impacts to the protected species are unavoidable additional mitigation measures will be implemented that are proportionate to ensure no net loss of Avon Ecology I EcIA 241121-H17-1-1 24 biodiversity and ideally a net gain. Further surveys could be required to inform the required mitigation, and a Natural England mitigation licence could be required before works can legally continue. - If a protected species such as a reptile, amphibian and/or hedgehog are identified they will be transported by an ecologist to a suitable refugia in the near vicinity such as the adjacent copse/hedgerow or the eastern border of the Site. If the weather conditions are unfavourable, they will be kept in temporary care until they can be released without risk of injury. - The vegetation pruning (hedgerow H1) and demolition works should seek to avoid the breading bird season which is considered to be from March to August inclusive. If this is not possible, immediately prior to the building’s demolition and vegetation clearance a suitably qualified ecologist will inspect the building’s bat potential roost features and the Site for breeding birds and other protected species. If an active nest is confirmed, works will likely need to be delayed until the chicks have successfully fledged. - The logs piles on Site will be removed by hand to avoid mechanical injury of species such as but not limited to hedgehogs. - Any arisings from the development that are to remain on Site for longer than a week will be stored in containers such as skips to reduce the potential of them becoming refugia features for wildlife. - There will be no night-time working or disturbance associated with the construction works at night such as but not limited to artificial light spill. No artificial light spill or noisy construction tasks should be completed within or adjacent to buildings B2 and B4 or near the brook. - The works including storage material will avoid the tree root protection zone of T1. - To prevent trapping animals, any excavations will be suitably covered each night. Alternatively, a ramp will be left in the excavation to enables safe egress for wildlife such as badgers and hedgehogs. - All pollutants or hazardous chemical will be in stored secure, spill-proof containers and no closer than 10m the edge of the brook’s embankment. Any construction activities such as cement mixing or re-fuelling will also avoid the 10m buffer from the brook. Spill kits will be readily available on-site to quickly address any accidental spills of hazardous materials. - Silt and debris control measures will be implemented in the event of any flood risk management works to the brook or its tributaries. The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority. Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and SWDP policy 22. |
| One general purpose bird box and one bat box shall be provided and appropriately located on site and made available for use before first occupation of the development hereby approved and thereafter retained. Reason: In the interests of biodiversity, further to policy SWDP 22. . |
| The structures identified for removal in drawing 24091 / 05b shall be removed before first occupation of the dwellinghouse hereby approved. Reason: In the interests of character and appearance to reduce the visual impacts, further to policy SWDP 21 and SWDP 25. |
| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
