The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission 21/01276/FUL approved on 25th May 2023. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).

No development above ground floor slab level shall commence until a drawing showing the details of the proposed access, turning areas and visibility splays serving the proposed development have been submitted to and agreed in writing by the Local Planning Authority. The development hereby approved shall not of be brought into use until the approved facilities have been provided. The visibility splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. REASON: In the interests of highway safety.
The Development hereby approved shall not be brought into use until the parking facilities shown on Drawing 391-00-160 P3 ‘Parking Standards’ has been provided. These areas shall thereafter be retained and kept available for their approved use at all times. REASON: In the interests of highway safety and to ensure sufficient parking provision.
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. REASON: In the interests of highway safety.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
No development above ground floor slab level shall commence until details of the following highway improvements/offsite works/site access works have been submitted to and approved in writing by the Local Planning Authority:- • Footway and pedestrian crossing point(s). This infrastructure is to be provided through a Section 278 Agreement Have been constructed and completed in accordance with County Specifications. REASON: To ensure the safe pedestrian movements across the highway.
The Development hereby permitted shall not be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details shown on drawing 391-00-160 P3 ‘Parking Standards’ and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. REASON: To comply with the Council’s parking standards.
The Development hereby approved shall not be occupied until the applicant has submitted to and had approval in writing from the Local Planning Authority a residential Travel Welcome Pack promoting sustainable forms of access to the development. The pack shall be provided to each resident at the point of occupation. REASON: To reduce vehicle movements and promote sustainable access.
The Development hereby approved shall not commence until a Construction Environmental Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:- • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway; • Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc); • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring. • Details of any temporary construction accesses and their reinstatement. • A highway condition survey, timescale for re-inspections, and details of any reinstatement. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the local planning authority. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety.
On completion of works the development shall be inspected by a qualified ecologist and a statement of conformity shall be submitted to the Local Planning Authority to confirm the mitigation and enhancement measures for biodiversity have been implemented in accordance with the details approved under conditions 25, 26, 27 and 28 of this permission. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with paragraphs 109 and 118 of the Framework and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017.
No development, including demolition shall commence until a detailed arboricultural report including details of tree protection measures and construction techniques has been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details. Reason - To ensure the appropriate protection and retention of existing trees/hedges and to preserve the amenities of the locality. In accordance with policies SWDP6, SWDP24 and part 16 of the NPPF.
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts. Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policies SWDP6, SWDP24 and part 16 of the NPPF.
Before preparation of any groundworks and foundations on site for the development hereby approve a scheme of hard and soft landscaping, including the green infrastructure areas, shall be submitted to and approved in writing by the Local Planning Authority. These details shall include indications of all existing trees and hedgerows on the land, including those to be retained. Soft landscape details shall include planting plans, written specifications, schedules of plants - noting species (which should be indigenous), planting sizes and proposed density. All planting, seeding and/or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the building(s) or the completion of the development, whichever is the sooner, and any trees, shrubs, hedges or plants which within a period of five years from the completion of development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. All hard landscaping comprised in the approved details of landscaping shall be carried out before the completion or first occupation of the development, whichever is the sooner. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with Policies SWDP 5, SWDP21 and SWDP25 of South Worcestershire Development Plan.
Notwithstanding the submitted details no boundary treatments shall be erected until details of the boundary treatment to be erected have been submitted to and approved in writing by the Local Planning Authority. These details shall include a plan detailing the position of all proposed boundary treatment and annotated or accompanied by a schedule specifying the type, height, composition and appearance of boundary treatment throughout the site. The approved boundary treatment shall be erected before the development is first brought into use and thereafter retained in that form, notwithstanding the provisions of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking and re-enacting that Order with or without modification). The boundary treatments shall include the external site boundaries, the treatment of plot frontages and boundaries between plots. Reason: In the interests of residential and visual amenity in accordance with Policies SWDP 21 and 25 of the South Worcestershire Development Plan.
Notwithstanding the maintenance details submitted as part of the application before the first occupation of the development hereby permitted a schedule of landscape maintenance in perpetuity has been submitted to and approved in writing by the local planning authority. The schedule shall include details of the arrangements for its implementation, long-term design objectives, management responsibilities and maintenance schedules for all landscape areas (excluding domestic gardens). The approved landscape maintenance schedule shall be fully implemented. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with Policies SWDP 21 and SWDP 25 of the South Worcestershire Development Plan.
The development hereby permitted shall not be occupied/first used until full details of all foul water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
The development hereby approved shall be carried out in accordance with the surface water drainage strategy “Drainage Strategy Report – 10.10.25 rev C”. The drainage works shall be implemented before the first occupation of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
(A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and: 1) The programme and methodology of site investigation and recording. 2) The programme for post investigation assessment. 3) Provision to be made for analysis of the site investigation and recording. 4) Provision to be made for publication and dissemination of the analysis and records of the site investigation. 5) Provision to be made for archive deposition of the analysis and records of the site investigation. 6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation. (B) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason: In accordance with the requirements of paragraphs 189 and 199 of the National Planning Policy Framework 2012 (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016.
Before the commencement of development hereby approved, a site investigation of the nature and extent of contamination shall be carried out. A site investigation methodology shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the investigation. Before the commencement of construction works on the development hereby permitted, the result of the site investigation shall be submitted to, and approved in writing by the local planning authority. If this report identifies any contamination, the report shall specify the measures to be taken to remediate the site to render it suitable for the development hereby permitted, as well as an implementation timetable. The site shall be remediated in accordance with the approved measures and timetable. Reason: To ensure that the proposed development avoids significant adverse impacts from pollution in accordance with policy SWDP31 of the South Worcestershire Development Plan.
No development above ground floor slab level shall commence until, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:- - the overall predicted energy requirements of the approved development; - the predicted energy generation from the proposed renewable/low carbon energy measures; and - an implementation timetable for the proposed measures. The development shall be carried out in accordance with the approved details Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan.
The materials to be used in the hereby approved development shall be as set out on drawing 391-00-620 P3 ‘Materials Layout’ and within the ‘Materials Finishes Schedule P1 – ‘Land at Wheatfield Court, Callow End, Worcester’. Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with Policy SWDP 21 of the South Worcestershire Development Plan.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
The granting of this planning permission does not remove any obligations on the applicant to undertake a technical design check of the proposed highway works with the Highway Authority, nor does it confirm acceptance of the proposal by the Highway Authority until that design check process has been concluded. Upon the satisfactory completion of the technical check the design would be suitable to allow conditions imposed under this permission to be discharged, but works to the public highway cannot take place until a legal agreement under Section 278 of the Highways Act 1980 has been entered into and the applicant has complied with the requirements of the Traffic Management Act 2004. The applicant is urged to engage with the Highway Authority as early as possible to ensure that the approval process is started in a timely manner to achieve delivery of the highway works in accordance with the above mentioned conditions. The applicant should be aware of the term “highway works” being inclusive of, but not limited to, the proposed junction arrangement, street lighting, structures and any necessary traffic regulation orders
If it is the applicant's intention to request the County Council, as Highway Authority, to adopt the proposed roadworks as maintainable at the public expense, then details of the layout and alignment, widths and levels of the proposed roadworks, which shall comply with any plans approved under this planning consent unless otherwise agreed in writing, together with all necessary drainage arrangements and run off calculations shall be submitted to the County Council's Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No works on the site of the development shall be commenced until these details have been approved by the County Council as Highway Authority and an Agreement under Section 38 of the Highways Act, 1980, entered into.
It is not known if the proposed roadworks can be satisfactorily drained to an adequate outfall. Unless adequate storm water disposal arrangements can be provided, the County Council, as Highway Authority, will be unable to adopt the proposed roadworks as public highways. The applicant is, therefore, advised to submit the engineering details referred to in this conditional approval to the County Council's County Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP at an early date to enable surface water disposal arrangements to be assessed.
Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway.
The applicant's attention is drawn to the need to ensure that the provision of the visibility splay(s) required by this consent is safeguarded in any sale of the application site or part(s) thereof. Planning Obligations
The applicant should provide the following planning obligations through a suitable legal mechanism. • Specific Purpose – Improvements to Public & School Transport Links and associated infrastructure • Contribution - £17,332 • Trigger – Prior to first occupation • Retention Period – Five Years
No development above ground floor slab level of any part of the development hereby permitted shall take place until, details of facilities that allow occupiers to separate and store waste for recycling and recovery shall be submitted to, and approved in writing by, the Local Planning Authority. Development shall be carried out in accordance with the approved details. Reason: To ensure a satisfactory form of development, in accordance with Policy SWDP21 and Policy SWDP 33 of the South Worcestershire Development Plan.
Notwithstanding the submitted levels before preparation of levels on site for the development hereby approved, the finished ground floor levels of the buildings in relation to the existing and proposed site levels, the adjacent highway and adjacent properties, together with details of levels of all accesses to include pathways, driveway, steps and ramps, retaining walls and drainage features shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved scheme unless the Local Planning Authority gives its written consent to any variation. Reason: In order to achieve a satisfactory form of development with regard to the topography of the site in accordance with Policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The hereby approved development shall be carried out in accordance with the details set out in the submitted Water Management Statement retained thereafter. Reason: To ensure sustainability measures are taken into account in the development in accordance with Policies SWDP 21 and SWDP 30 of the South Worcestershire Development Plan.
No development, vegetation removal, site clearance, and below ground works shall take place until a construction environmental management plan (CEMP: Biodiversity) has been submitted to and approved in writing by the local planning authority. The CEMP (Biodiversity) shall be informed by updated ecological surveys as appropriate, but will include the following: a. Risk assessment of potentially damaging construction activities; b. Identification of “biodiversity protection zones”; c. Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts both onsite and nearby during construction. These may be provided as a set of method statements/mitigation strategies and shall include mitigation measures to prevent harm to, reptiles, amphibians, nesting birds, mammals, and retained habitats on site. This CEMP should also clearly cross-reference the separate bat mitigation strategy; e. The location and timing of sensitive works to avoid harm to biodiversity features; f. The times during construction when specialist ecologists need to be present on site to oversee works; g. Responsible persons and lines of communication; h. The role and responsibilities on site of an ecological clerk of works (ECoW) or similarly competent person; i. Use of protective fences, exclusion barriers, silt management measures and warning signs. The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with polices SWDP 22 of the South Worcestershire Development Plan, paragraphs 187 and 193 of the National Planning Policy Framework (NPPF) and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017).
Prior to demolition of the building and closure of the cellar, details of the bat mitigation, compensation, enhancement and monitoring measures including detailed plans for construction of a stand-alone ‘bat house’ shall be submitted to and approved in writing by the Local Planning Authority. The approved features shall be installed in accordance with the approved details prior to the first occupation of the development hereby approved and retained thereafter. On completion of the works the site shall be inspected by a suitably qualified ecologist to confirm that all the measures have been implemented in accordance with the details approved under this condition and to a satisfactory standard. A letter of certification shall thereafter be issued by the ecologist and confirmed in writing to the local planning authority. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with polices SWDP22 of the South Worcestershire Development Plan, paragraphs 187 and 193 of the National Planning Policy Framework (NPPF) and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017).
A “lighting design strategy for biodiversity” shall be submitted to and approved in writing by the local planning authority prior to the commencement of development. The strategy shall be based on Guidance Note 08/23. Bats and Artificial Lighting at Night, by the Bat Conservation Trust and ILP and shall include the following: i. Identification of the areas/features on site that are particularly sensitive for bats and that are likely to cause disturbance in or around their breeding sites and resting places, or along important routes used to access key areas of their territory, for example, for foraging and; ii. Show how and where external and internal lighting will be installed (through the provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent bats using their territory or having access to their breeding sites and resting places. All lighting shall be installed in accordance with the specifications and locations set out in the strategy, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and minimise impacts on protected species in accordance with local Policy SWDP22 and SWDPR27, and paragraphs 187, 193 and 198 of the National Planning Policy Framework (NPPF).
Prior to first occupation an ecological design strategy (EDS) for compensation and enhancement measures for protected species (other than bats) including amphibians, reptiles, small mammals and birds (including hedgehog friendly/wildlife permeable boundary treatments) shall be submitted to and approved in writing by the local planning authority. The EDS shall include the following: a. Purpose and conservation objectives for the proposed works. b. Review of site potential and constraints. c. Detailed design(s) and/or working method(s) to achieve stated objectives. d. Extent and location/area of proposed works on appropriate scale maps and plans. e. Type and source of materials to be used where appropriate, e.g. native species of local provenance. f. Timetable for implementation demonstrating that works are aligned with the proposed phasing of development. g. Persons responsible for implementing the works. h. Details of initial aftercare and long-term maintenance. i. Details for monitoring and remedial measures. j. Details for disposal of any wastes arising from works. The EDS shall be implemented in accordance with the approved details and all features shall be retained in that manner thereafter. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with polices SWDP22 of the South Worcestershire Development Plan, paragraphs 187, 192 and 193 of the National Planning Policy Framework (NPPF).
