Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – "Site Location", "Block Plan Existing", "Block Plan Proposed", E100, E200, E300, P002, P100, P101, P200, P201, P300, P301, 3200, 4100. Reason: To define the permission.
No building hereby permitted shall be occupied until details of the design, implementation, maintenance and management of sustainable urban drainage/surface water drainage works have been submitted to and approved in writing by the local planning authority. The submitted details shall: 1. provide information about the design storm period and intensity, the method employed to delay and control the surface water discharged from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters; 2. include a timetable for its implementation; and 3. provide a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public authority or statutory undertaker and any other arrangements to secure the operation of the scheme throughout its lifetime. The development shall be carried out, and the drainage maintained/managed, in accordance with the approved details. Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.
In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation. No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements 1 to 4 below have been complied with: 1. Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency's 'Land Contamination: Risk Management' guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place. 2. Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation. 3. The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. 4. Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site. REASON To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
Prior to the building occupied as a dwelling, details of electric vehicle charging points shall be submitted to the Local Planning Authority for written approval. Once approved, these details shall be fully implemented. Once installed, they shall be retained on site for the duration the permission. Reason: In the interests of encouraging sustainable transport methods.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
Prior to the first use/occupation of the development hereby permitted, the set out mitigation and enhancement measures in the submitted Bat and Nesting Bird Assessment (12 February 2025) shall be fully implemented and remain thereafter. Reason: To protect this potential habitat of protected species under the Wildlife and Countryside Act 1981 and in accordance with Policy SWDP22 of the South Worcestershire Development Plan.
The Development hereby approved shall not be occupied until the visibility splays shown on drawing 3200 rev.P01 have been provided. The splays shall at all times be maintained. Reason: In the interests of highway safety in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
Before the commencement of development hereby permitted, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:- - the overall predicted energy requirements of the approved development; - the predicted energy generation from the proposed renewable/low carbon energy measures; and - an implementation timetable for the proposed measures. The development shall be carried out in accordance with the approved details. Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan.
Prior to the first use/ occupation of the building hereby approved, details of superfast broadband facilities or alternative solutions to serve the building hereby approved shall be submitted to and approved in writing by the local planning authority. The submitted details shall include an implementation programme. The facilities shall be provided in accordance with the approved details. Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016.
The development hereby approved shall not be occupied until sheltered and secure cycle parking to comply with the Council’s adopted Streetscapes Design Guide has been provided in accordance with details which shall be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
No development shall begin until a Construction Environment Management Plan (CEMP) has been submitted to and approved in writing by the Local Planning Authority. The CEMP shall include the following details:- a. details to minimise the impact of noise, vibration and dust from construction, demolition and site clearance activities and the traffic associated with this development, including a scheme for vehicle wheel cleaning and other measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway. The CEMP shall broadly accord with BS 5228 - 1&2:2009 +A1:2014 (Code of practice for noise and vibration control on construction and open sites) and the WRS Demolition and Construction Guidance; b. details of site operative parking areas, material storage areas and the location of site operative facilities (offices, toilets etc); c. restrictions on burning; d. details in relation to the prevention of pollution of waterways; e. construction exclusion zones to prevent soil compaction in areas to be planted and remediation proposals for any soil compaction which does occur; f. a strategy for the handling and storage of topsoil; g. a management strategy and proposals for the minimisation of construction waste; h. details of any temporary construction accesses and their reinstatement; i. a scheme of temporary signage to direct construction related traffic to enter and exit the site; and j. a highway condition survey, timescale for re-inspections, and details of any reinstatement. k. where the development site includes a public right of way, measures to manage and maintain safe use of the right of way by the public and avoid or minimise the need for temporary closure. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved in writing by the Local Planning Authority. The CEMP should generally comply with the requirements of Worcestershire Regulatory Services Code of Best Practice for Demolition and Construction Sites 2nd Edition September 2020 and the Construction Logistics and Community Safety (CLOCS) Standard www.clocs.org.uk/clocsworks Reason: To protect existing and new occupiers of residential areas from the unreasonable effects of noise, vibration, light and dust nuisance, to avoid and mitigate for any potential impact on protected species, minimise the risk of accidents and ensure public rights of way are kept available where possible for the duration of the construction, in accordance with Policies SWDP4, 21 and 22 of the South Worcestershire Development Plan.
The use hereby permitted shall not operate outside the following hours of 07:00 and 18:00 Monday to Friday 07:00 and 13:00 Saturday The development shall be closed on Sundays and Public Holidays Reason:- To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan.
Prior to construction above foundation level, details of the materials to be used in the construction of the external surfaces of the building hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - type, colour, texture, size, coursing and finish of brickwork; - type, colour, texture, size and design of roofing materials; - sample panel of the brickwork, - a precise specification of the proposed external cladding including colour and finish - details of external doors/garage doors and windows including colour and finish The development shall be carried out using the materials as approved. Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.
Notwithstanding the provisions of Schedule 2, Part 3, Class I of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), the use of the units hereby permitted shall be limited to Class B2 (General Industrial) Use of the Town and Country Planning (Use Classes) Order 1987 (as amended) and there shall be no change of use to a use within Class B8 of the aforementioned Order without the grant of planning permission Reason: To facilitate control over the proposal's potential impact on residential amenity and traffic movements in accordance with Policy SWDP 1.
There shall be no outdoor noise generating works at the application site. This would include mechanical and physical repairs and maintenance of vehicles or machinery and the use of power tools. Reason: In order to protect residential amenity in accordance with Policies SWDP21 and SWDP31 of the South Worcestershire Development Plan.
With any demolition of non-residential buildings, WRS advise that consideration is given to the presence of asbestos containing materials (ACMs) in the existing building(s) and any ACMs removed during alterations should be disposed of appropriately such that the development site may not be considered contaminated land under Part 2A at a later date. Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
