Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission M/23/01595/FUL dated 24 January 2024. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – - P301 Rev. G Reason: To define the permission.
Prior to their installation on site as part of this approved development details of the materials (including samples where appropriate) to be used in the construction of the external surfaces of the development hereby permitted shall be submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - Details to include the type, size and appearance of the proposed solar powered hot water heating panels. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and policies MHE1 and MD2 of the Malvern Town Neighbourhood Plan.
The works are adjacent to the railway & also within 10m so before any works commence on site the applicant must interface & agree all works with Network Rail. (1) The proposed solar panels must be non-reflective to ensure they do not impact upon train drivers ability to perceive signals. (2) The proposal area may be subject to a demarcation agreement so in addition to any planning consent the applicant will need agreement to the works from PropertyRequestsNWC@networkrail.co.uk (3) The balconies must not over-sail or encroach onto NR airspace or land. (4) The applicant is to submit the details to the link below.
