Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission 21/02078/DUL dated 29.09.2022. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: 4538D 03; 4538LP 03; 4538 SS02; 45338A 02; Block Plan; Site Location. Reason: To define the permission.
Before the first occupation of the dwelling hereby permitted the window in the first floor north elevation shall be fitted with Pilkington Level 4 obscured glazing or equivalent and shall be permanently retained in that condition thereafter. Reason - To protect the amenities of the adjoining property from unacceptable overlooking in accordance with policy SWDP21 of the South Worcestershire Development Plan.
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety.
The Development hereby permitted shall not be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details as specified on the approved plan 4538BP-03 and the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards.
The Development hereby approved shall not be brought into use until the access, turning area and parking facilities shown on Drawing 4538LP 03 has been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
The development must be carried out in accordance with the detail as specified in the Construction Environmental Management Plan document and read in conjunction with drawing no 4538CON-01 as formally discharged on the 12 December 2023 to comply with Condition 7 of planning permission 21/02078/FUL. The approved plan shall be implemented throughout the construction. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety.
As part of the development hereby approved all boundary treatments shall be erected in accordance with the specified details on drawing no 4538LA-02 FINAL as formally discharged on the 12 December 2023 to comply with Condition 8 of planning permission 21/02078/FUL. Development shall be carried out in accordance with the approved details and constructed before the first occupation of the dwelling hereby approved. Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
Before the first occupation of the development hereby permitted the new hedgerow shall be planted as specified on the approved plan 4538LP-02 rev 01 and shall thereafter be retained in that form, notwithstanding the provisions of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) Order 2015, as amended, (or any Order revoking and re-enacting that Order with or without modification). If any part of the hedgerow shall die, is removed or become seriously damaged or diseased it shall be replaced in the next planting season with others of similar size and species. Reason : To ensure the proposed development does not have an adverse effect on the character and appearance of the area or setting of the Conservation Area in accordance with policies SWDP6, SWDP21. SWDP24 and SWDP25 of South Worcestershire Development Plan.
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts. This protective fencing shall remain in place until the completion of development and nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to the first use/occupation of the development hereby permitted, the surface water management as set out in the approved plan 4538D-03 shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
Prior to the first occupation of the dwelling hereby approved, details of superfast broadband facilities or alternative solutions to serve the dwellings hereby approved shall be submitted to and approved in writing by the local planning authority. The submitted details shall include an implementation programme. The facilities shall be provided in accordance with the approved details. Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays, Public or Bank Holidays. Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway.
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
