Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Reason: To define the permission.
Before the commencement of development hereby permitted an ecological mitigation and enhancement scheme shall be submitted to and approved in writing by the local planning authority. The scheme shall be based on the recommendations contained within the the Ecological Technical Note (Lighting), the Preliminary Ecological Appraisal by Thomson Environmental Consultants dated September 2024, the Bat Survey Report by Abricon Ltd dated January 2025 and the Biodiversity Net Gain Report report by Thomson Environmental Consultants dated January 2025 and shall include an implementation timetable. The works shall thereafter be carried out in accordance with the approved details and timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts. Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.
The development hereby permitted shall not be occupied/first used until full details of all surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
Development shall proceed in accordance with the approved Arboricultural Method Statement by Archway Building Consultancy dated 10 April 2025, the Arboricultural Impact Assessment (Drawing Arbtech AIA 01 Rev 03) and the Tree Protection Plan (Drawing number 108-A-710-T02 Rev 03). Once the approved tree protection measures have been implemented, and prior to any construction works taking place, a letter of compliance, prepared by a suitably qualified arboricultural consultant, shall be submitted to the local planning authority. Reason: To ensure that tree protection measures have been implemented, as approved, in order to prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.
Within three months following completion of the approved landscaping, a statement of conformity, prepared by a qualified landscape architect, shall be sent to the Local Planning Authority to confirm the approved landscaping scheme has been successfully implemented and approved planting specification. Reason: To ensure the successful implementation and the long term success of the approved landscaping scheme and to ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016.
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The Development hereby approved shall not be brought into use until the access, parking and turning facilities have been provided as shown on Drawing P-015 Rev 01 Proposed Site Plan. These areas shall thereafter be retained and kept available for their respective approved uses at all times. Reason: To ensure conformity with submitted details and in the interests of highway safety to comply with Policy SWDP21 of the South Worcestershire Development Plan 2016.
The Development hereby approved shall not be brought into use until the visibility splays shown on Drawing 24-217-T-014 Rev E Swept Path Analysis Mini Bus Access/Egress have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. Reason: In the interests of highway safety to comply with Policy SWDP21 of the South Worcestershire Development Plan 2016.
The Development hereby approved shall not be brought into use until pedestrian visibility splays of 2m x 2m measured perpendicularly back from the back of footway shall are provided on both sides of the access. The splays shall thereafter be maintained free of obstruction exceeding a height of 0.6m above the adjacent ground level. Reason: In the interests of highway safety to comply with Policy SWDP21 of the South Worcestershire Development Plan 2016.
No development shall commence, with the exception of soft strip demolition works, until details of the highway improvements and site access works comprising:- • Minimum 1.5 metre wide footway along southern side of the site’s internal access road up to the proposed automated pedestrian gate; and • Dropped kerbs with tactile paving pedestrian crossing across B4211 Church Street, near to its junction with Albert Road North. Have been submitted to and approved in writing by the Local Planning Authority. The school/development shall not be first occupied until the works have been constructed in accordance with the approved details. Reason: To ensure the staff are offered a genuine choice of sustainable transport modes, to reduce single occupancy vehicle movements, and to ensure safe and suitable access for all users and to comply with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan 2016.
The Development hereby approved shall not be brought into use until sheltered and secure cycle parking for staff to comply with the Council’s adopted cycle parking standards has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the council's parking standards and to comply with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan 2016.
The vehicle parking arrangements (including student drop-off and pick-up arrangements and staff parking) for the Development hereby approved shall be undertaken in accordance with the details contained within the submitted Car Park Management Plan (CPMP) (document reference 24-217_Malvern Hills CPMP-V1.1). The approved Plan shall be monitored continuously throughout every school year and formally reviewed at the end of each school term, so long as the site is used as a SEN school. Any revisions to the CPMP following monitoring and reviewing must be recorded and justification provided, and approved in writing by the Local Planning Authority. The CPMP shall be made available for inspection upon request from the Local Planning Authority. The car park (including student drop-off and pick-up arrangements and staff parking) shall only be operated in accordance with the approved CPMP, or any approved revised CPMP. Reason: To ensure that the site’s car park and student drop-off and pick-up arrangements are acceptable such that severe or unacceptable safety impacts do not arise and to comply with Policy SWDP21 of the South Worcestershire Development Plan 2016.
No development shall commence, with the exception of soft strip demolition works, until an updated Construction Traffic Management Plan (CTMP) has been submitted to and approved in writing by the Local Planning Authority. This must include but not be limited to:- • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway, including a wheel cleaning facility. • Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc). • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring. • Vehicle routing (excluding use of Zetland Road between the A449 Worcester Road and Bank Street for access for construction vehicles). • Measures to ensure Public Rights of Way remain unobstructed. • Temporary traffic management arrangements, including a temporary parking suspension opposite the site access during construction of the development. • Mitigation for impacts on residents, businesses, and public transport services. • Details of any temporary construction accesses and their reinstatement. • Detailed tracking assessments for all vehicle types requiring access to the site, performing all entry and exit manoeuvres at the access and nearby highway junctions. • Key contact details, including an emergency telephone number. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved in writing by the Local Planning Authority. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety, to comply with Policy SWDP21 of the South Worcestershire Development Plan 2016.
No development shall commence, with the exception of soft strip demolition works, until a detailed Demolition Method Statement has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:- • Sequence of works and methodology for the demolition/removal of any structures supporting or abutting the public highway, including sequence of works for the demolition of any basement walls; • Details of equipment, tools and machinery to be used in any demolition works; • Fall prevention measures; • Details and plan of any proposed hoardings, temporary footway closures and diversions; and • Details and plan of any equipment which may over-sail the public highway. The measures set out in the approved Statement shall be carried out and complied with in full during the demolition of the existing structures and construction of the development hereby approved. Reason: In the interests of highway safety to comply with Policy SWDP21 of the South Worcestershire Development Plan 2016.
The Development hereby approved shall not be brought into use until an updated School Travel Plan has been submitted to and approved in writing by the Local Planning Authority. This Plan shall be implemented and monitored in accordance with the regime contained within the Plan. The updated Plan shall include modal shift targets, a Travel Plan coordinator with contact details (to be appointed by the first use of the proposed development), updated baseline modal share data following a baseline travel survey of students and staff, and information on the funding of the Travel Plan (including the implementation, as well as monitoring for a period of five years). In the event of failing to meet the targets within the Plan, a revised Plan shall be submitted to and approved in writing by the Local Planning Authority to address any shortfalls, and where necessary make provision for and promote improved sustainable forms of travel to and from the site. The approved Travel Plan shall be implemented, monitored and reviewed in accordance with the approved details. Reason: To ensure the development site is offered a genuine choice of sustainable travel modes and to promote sustainable access to the development site and to comply with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan 2016.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
