Malvern Hills District Council, The Council House, Avenue Road, Malvern, Worcestershire WR14 3AF HEREBY CERTIFY that application reference M/25/00222/CLE registered on 10th February 2025 for a Certificate of Lawfulness Existing Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice and outlined in red on the plan attached to this Notice, for the following reason :- That the matter described in the First Schedule to this Notice was substantially completed at least four years before the date of the application for this Certificate. However, there are discrepancies between the measurements of the applicants site survey, the Council's mapping system and the overlay of the 'as built' position of the dwelling which throws into doubt whether the original approved plan GC/77/03c was accurately plotted. As such accurately establishing the differences between the 'as approved' and 'as built postion' is problematic. However, notwithstanding the above, based on the evidence submitted by the applicant shown on the 'Overlay between Site Survey Data (property only) & Original Site Plan' within the Planning Statement the differences are not a significant material change to the approved plan subject to 77/01096/TEN and the original planning permission was therefore implemented and the agricultural workers occupancy condition No.3 imposed on outline planning permission allowed on appeal reference T/APP/5244/A/76/10854/G9 dated 12.07.1977 still remains on the property.
