Condition Details / Information Notes
The proposed development would have a detrimental impact on the residential amenity of the existing and future occupiers of Sandleigh and Rayvue by way of causing a reduction in the amount of natural light being received by habitable rooms and by way of representing an unduly overbearing form of development in relation to the internal and external private spaces of these dwellings, contrary to Policy SWDP 21 of the South Worcestershire Development Plan (2016), the South Worcestershire Design Guide SPD (2018) and Chapter 12 of the National Planning Policy Framework.
Due to its size, form and design, the proposed dwelling would represent an incongruous addition to the street scene along Old Malvern Road, which would fail to integrate effectively with its surroundings in terms of its form and which would fail to reinforce local distinctiveness. As such, the proposed dwelling would be out of character with the surrounding built environment along Old Malvern Road, to the detriment of the visual amenity of the surrounding area and street scene, contrary to Policy SWDP 21 of the South Worcestershire Development Plan (2016), the South Worcestershire Design Guide Supplementary Planning Document (2018) and Chapter 12 of the National Planning Policy Framework.
Only one functional parking space would be provided, which fails to comply with the minimum parking space requirement for a two-bedroom property. Furthermore, due to the size of the proposed driveway and the location of the site on Old Malvern Road, vehicles would have to exit the site in reverse gear. No information has been provided with the application which demonstrates that the required visibility splays as set out within the Worcestershire County Council Streetscapes Design Guide (2022) and the Highways Standing Advice Document, could be achieved. In the absence of this information and based on the size of the proposed driveway and the site’s location on Old Malvern Road, it is considered that the proposal would result in an increase in instances of conflict between vehicles, vehicles and cyclists, and vehicles and pedestrians. As such, it is considered that the proposed development would have a detrimental impact on highway and pedestrian safety along Old Malvern Road, contrary to Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan (2016), Worcestershire County Council Streetscapes Design Guide (2022) and Chapter 9 of the National Planning Policy Framework.
No mechanism (a Section 106 agreement or Unilateral Undertaking) has been entered into to secure an affordable housing planning contribution. As such the application is contrary to Policy SWDP 15 of the South Worcestershire Development Plan (2016), guidance in the Council's Developer Contributions SPG and Affordable Housing SPG, as well as guidance contained in the National Planning Policy Framework.
In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan and Supplementary Planning Documents and provided the applicant with the opportunity to engage with the Council's pre-application advice service, in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however identified substantial issues associated with the proposal and the work required in order to address these issues would go beyond the scope of this planning application. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
