Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents: - Location Plan - Proposed Block Plan - AM1 Existing & Proposed Studio and Stable Floor Plans - AM2 Existing & Proposed Barn Floor Plans - AM3 Existing & Proposed Barn Elevations. Reason: To define the permission.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal report carried out by Cotswold Wildlife Surveys and dated 29th January 2025 and submitted with this application. In particular:- - Any tree and shrub removal that is subsequently required, should be undertaken outside the period 1st March to 31st August inclusive. If this time frame cannot be avoided, a close inspection of the trees and shrubs to be removed will be undertaken by an ecologist prior to clearance. Work will not be carried out within a minimum of 5.0 metres of any in-use nest, although this distance could be more depending on the sensitivity of the species. Any in-use nest will be allowed to fledge before it is disturbed. - Care will be taken at all times during any vegetation removal and topsoil stripping. Any small mammals disturbed or uncovered will either be caught by hand and relocated to a safe area, or left to vacate the work site in their own time. - If excavations are to be undertaken, if trenches cannot be infilled immediately then they will either be covered overnight or escape routes will be provided. These can be in the form of branches or boards placed on the bottom of the trench, with their upper ends above ground level and touching the sides, or sloping ends left in trenches. - If any tree or scrub removal cannot be timed appropriately to avoid the bird nesting period (considered to be March to August inclusive), then further surveys of the trees and/or scrub to be removed will be required. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The approved Biodiversity Gain Plan shall be implemented in accordance with the details and timescale agreed within the plan and maintained thereafter in accordance with the approved Habitat Management and Monitoring Plan (HMMP). Reason – To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP 22 of the South Worcestershire Development Plan.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The education use shall be in accordance with the details set out in the submitted Planning Statement and for no other purpose, including any other purpose in Class F of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. Reason: The site is in the open countryside and has been justified as an excepted form of development therein due to its specific nature requiring a rural agricultural location. Other forms of education/learning development may not be appropriate in this location having regard to Policies SWDP2, SWDP4 and SWDP21.
The education use hereby permitted shall not be operational outside the following hours: - Weekdays between 9:30am and 3:30pm Monday – Friday - term time only. Reason:- To ensure the proposal preserves residential amenity in accordance with policy SWDP21 of the South Worcestershire Development Plan.
The Development hereby approved shall not be occupied until an area has been laid out within the site parking of 8 cars. This area shall thereafter be retained for the purpose of parking a vehicle only. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policy SWDP21.

The Development hereby permitted shall not be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards in accordance with Policy SWDP21.
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety and to comply with Policy SWDP21.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
