Malvern Hills District Council, The Council House, Avenue Road, Malvern, Worcestershire WR14 3AF HEREBY CERTIFY that on the 17/01/2025 the matter described in the First Schedule to this Certificate in respect of the land specified in the Second Schedule to this Certificate and outlined in red on the plan, would be lawful within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason :- That the matter described in the First Schedule constitutes “permitted development” under the provisions of Schedule 2, Part 1 Class B of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) and therefore would not require the express consent of any planning authority.

Buildings are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and Natural England must be contacted on 0845 6003078 for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the relevant contact details.
