The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission M/23/01149/FUL dated 20/02/2024. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).

The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Assessment and Bat Survey Report produced by Natasha James dated July 2023 and submitted with this application. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016
The works hereby permitted shall be carried out in accordance with the approved details of roof light window(s) set out in Planning Conditions Workbook prepared by Woldon (Revision C, 18/03/2025). Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan
The development shall be carried out using the approved materials for the construction of the external surfaces set out in Planning Conditions Workbook prepared by Woldon (Revision C, 18/03/2025). Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
The development shall be carried out using the approved joinery details and materials of windows and doors set out in Planning Conditions Workbook prepared by Woldon (Revision B, 18/03/2025). Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
The development shall be carried out in accordance with the approved details and timetable set out in Ecological Mitigation & Enhancement Strategy prepared by Focus Environmental Consultants (Ref 3006-2, January 2025). Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22 of the South Worcestershire Development and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017).
All lighting shall be installed in accordance with the specifications and locations set out in the approved lighting layout and strategy prepared by Ingleton Wood (refs: 7000193 IWD XX 00 DR E 5402 – P01 and 7000193-IWD-XX-XX-RP-E-5401) and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22 of the South Worcestershire Development and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017).
On completion of works, the development shall be inspected by a qualified ecologist and a statement of conformity and a copy of any bat licences and licence monitoring returns as appropriate shall be submitted to the Local Planning Authority to confirm the mitigation and enhancement measures for biodiversity have been successfully implemented in accordance with the details approved under this condition. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22 of the South Worcestershire Development and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017).
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety.
The Development hereby approved shall not be brought into use until the access, turning area and parking facilities shown on Drawing PLAN 3 – Proposed Site Plan has been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
The Development hereby approved shall not be brought into use until 1 electric vehicle charging spaces have been provided in accordance with a specification which shall be submitted to and approved by the Local Planning Authority and thereafter such spaces and power points shall be kept available and maintained for the use of electric vehicles as approved. Reason: To encourage sustainable travel and healthy communities.
The Development hereby approved shall not be brought into use until 1 accessible car parking spaces have been provided in a location to be agreed in writing by the Local Planning Authority and thereafter shall be kept available for disabled users as approved. Reason: To provide safe and suitable access for all.
The Development hereby approved shall not be brought into use until 1 secure motorcycle parking spaces have been provided in a location to be agreed in writing by the Local Planning Authority and thereafter shall be kept available for motorcycle parking as approved. Reason: To provide safe and suitable access for all.
The Development hereby approved shall not be brought into use until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards.
The measures and details set out in the approved Construction Environmental Management Plan prepared by Edgars (dated 17th December 2024) shall be carried out and complied with in full during the construction of the development hereby approved. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety.
The Development hereby approved shall not be brought into use until the applicant has submitted a Travel Plan using Modeshift STARS Business. They must meet green level accreditation before occupation and bronze level accreditation within 12 months of occupation. Reason: To reduce vehicle movements and promote sustainable access.
The archaeological watching brief shall be undertaken within 3 months of the planning decision and completed within 6 months of the planning decision, site investigation and post investigation assessment shall be completed in accordance with the programme set out in the Written Scheme of Investigation (report number 24n50wb) within 12 months of the planning decision. The development shall not be occupied until the provision has been made for analysis, publication and dissemination of watching brief results and archive deposition has been secured. Reason: In accordance with the requirements of paragraphs 207 and 218 of the National Planning Policy Framework (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall not be open to customers outside the following hours of 8:30-16:00 Monday to Friday 8:00-16:00 Sunday/Bank Holidays Reason:- To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
