Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan CG26 WRM 06d As Proposed GG19 WRM 05e As Proposed MHP; Arboricultural Survey, Impact Assessment, Protection Plan & Method Statement Reason: To define the permission.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Bat Survey Report dated September 2023 and the Reptile Precautionary Working Method Statement dated August 2023, both produced by Five Valleys ecology and submitted with this application. In particular: - Production of a Non-licensed Bat Precautionary Working Method Statement (PWMS) that will include the following: o Toolbox talk to contractors by a licensed ecologist prior to works; o Demarcating the location of Roost A1 and Roost B1, as appropriate; o Avoiding obstruction of flight lines to the roosts with scaffolding through appropriate design and erection in consultation with an ecologist; o Basic preventative measures to control noise, dust, vibration; o and no lighting during the hours of darkness during the construction phase. - Working methods as set out in section 2.4 of the Reptile Precautionary Working Method Statement (August 2024) will be implemented within the construction zone of the proposed garage. - The Sparrow Nest Box shall be installed on the western elevation of the house. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22 and SWDPR27 of the South Worcestershire Development Plan and paragraphs 180 and 186 of the National Planning Policy Framework (2023); and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations (2017)
On completion of works, the development shall be inspected by a qualified ecologist and a statement of conformity shall be submitted to the Local Planning Authority to confirm the mitigation and enhancement measures for biodiversity have been successfully implemented in accordance with the details approved under this condition. Reason - To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application - seeking amendments to the proposed development following receipt of the application - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
