Condition Details / Information Notes
The proposed three storey, semi detached dwellings (plots 7a and 7b) taken together with those approved under planning permission 21/01678/FUL would, due to the total number of dwellings proposed, result in overdevelopment of the site with each of the dwellings appearing cramped within their respective plots around the site. As such, the proposal would be contrary to policies SWDP21 and SWDP25 of the South Worcestershire Development Plan, policies MD1 and MH2 of the Malvern Town Neighbourhood Plan and the NPPF.
The proposed development, by reason of the demolition of the extensions/conservatory to make way for two, new build, three storey dwellings would undermine the connection between The Old Vicarage and Coach House which are both Non Designated Heritage Assets. The dwellings, which would be 3.6 metres higher than the existing Coach House, would spatially crowd out the Coach House and undermine its significance within the site. The development would therefore be contrary to policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan, policies MD1 and MHE1 of the Malvern Town Neighbourhood Plan, the Great Malvern Conservation Area Appraisal and the NPPF.
The proposed development, due to the available internal floorspace of plots 3, 4 and 5 and the external amenity areas of plots 3, 7a and 7b, would fail to meet the requirements as set out in the Technical Space Standards (nationally described spaces standard). This signifies the number of proposed dwellings and their respective internal/external space would not be suitable for a site of this size and would fail to protect the amenity of future residents. As such, the proposal would be contrary to policy SWDP21 of the South Worcestershire Development Plan, policy MH2 of the MTNP and the NPPF.
The proposed development would be subject to Biodiversity Net Gain improvements, however, no information has been submitted in this regard. Currently it is not possible to determine the impact on Biodiversity Net Gain and the application would therefore not be in accordance with policy SWDP22 of the South Worcestershire Development Plan (2016) or NPPF.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - considering the imposition of conditions In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
