Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – - 2327 1000- Revision B - 6337 LM XX XX DR L 1000- Rev A - 2327 1010- Revision F - 2327 3001- Revision F - 2327 3000 Revision F Reason: To define the permission.
No building operations above slab floor level shall take place until details of the materials to be used in the construction of the external surfaces of the dwelling hereby approved, have been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details. Reason: In order to ensure that the new materials are in keeping with the surrounding area and represent quality design in accordance with Policy SWDP 21 of the South Worcestershire Development Plan (2016), the South Worcestershire Design Guide Supplementary Planning Document (2018) and the National Planning Policy Framework.
No building operations above slab floor level shall take place until a scheme of landscaping has been submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include a plan detailing the disposition of planting, cross referenced to a schedule listing the species, size at time of planting, number of plants proposed or proposed planting density. The approved scheme shall be carried out in accordance with a timetable submitted to and agreed in writing by the Local Planning Authority. If within a period of five years from the date of the planting of any tree, shrub or hedging plant planted pursuant to this condition, that tree, shrub or hedging plant, or any tree, shrub or hedging plant planted in replacement for it, is removed, uprooted or destroyed or dies, or becomes, in the opinion of the Local Planning Authority, seriously damaged or defective, poorly established or moribund, another tree, shrub or hedging plant of the same species and size as that originally planted shall be planted at the same place, unless the Local Planning Authority gives its written approval to any variation. Reason: To ensure the environment of the development is improved and enhanced and does not have an adverse effect on the character and appearance of the area, in accordance with Policies SWDP 21 and SWDP 25 of the South Worcestershire Development Plan (2016), the South Worcestershire Design Guide Supplementary Planning Document (2018) and the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the parking and turning facilities have been provided as shown on drawing 2327 1010- Revision F. Reason - To ensure the provision of suitable parking and turning facilities and to maintain highway and pedestrian safety in accordance with Policy SWDP 4 of the South Worcestershire Development Plan (2016), the Worcestershire County Council Streetscapes Design Guide (2022) and the National Planning Policy Framework.
Before the first occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority. The boundary treatment shall be installed prior to first occupation of the dwelling in accordance with the approved plan and retained thereafter. Reason - To protect the amenities of the occupiers of surrounding properties and to ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with Policies SWDP 21 and SWDP 25 of South Worcestershire Development Plan (2016), the South Worcestershire Design Guide Supplementary Planning Document (2018) and the National Planning Policy Framework.
No building operations above slab floor level shall take place until an ecological enhancement scheme has been submitted to and approved in writing by the local planning authority. The scheme shall include an implementation timetable. The works shall thereafter be carried out in accordance with the approved details and timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP 22 of the South Worcestershire Development Plan (2016) and the National Planning Policy Framework
Prior to first occupation of the dwelling hereby approved, the measures recommended within the submitted energy strategy (Fenton Energy- Energy Strategy- Project: 5772KJ- 2025.01 SAP) shall be fully implemented and retained thereafter in accordance with the energy strategy. Reason: In order to ensure the incorporation of renewable and low carbon energy within the development, in accordance with Policy SWDP 27 of the South Worcestershire Development Plan (2016) and the National Planning Policy Framework.
Prior to first occupation of the dwelling hereby approved, details of measures to be used in order to ensure that the non-recycled water use per person will not exceed 110 litres per day shall be submitted to and approved in writing by the local planning authority. The approved measures shall be implemented prior to first occupation of the dwelling in accordance with the approved details and retained thereafter. Reason: To ensure that the development is water efficient in accordance with Policy SWDP 30 of the South Worcestershire Development Plan (2016) and the National Planning Policy Framework.
The development hereby permitted shall not be occupied until full details of all surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before first occupation of the development hereby permitted and shall be retained thereafter. Reason: To ensure development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP 28, SWDP 29 and SWDP 30 of the South Worcestershire Development Plan (2016) and the National Planning Policy Framework.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No significant amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
