| The extent and height of the raised decking relative to original ground levels on this sloping site would appear incongruous, visually intrusive and inappropriate in the context of its setting within the open countryside. Overall, the development would by reason of its siting, design and appearance result in visual intrusion and consequent harm to the character and appearance of the area which would not be adequately mitigated by new planting. Consequently, the development would be contrary to Policies SWDP 21, SWDP 25 and SWDP 35 and paragraph 88(c) of the NPPF. |
| A suitable foul and surface water drainage solution which would not exacerbate the risk of run-off has not been adequately demonstrated, nor the ground conditions assessed for the suitability of a soakaway. Consequently, the development would be contrary to Policies SWDP 29 and paragraphs 181 and 182 of the NPPF. |
| Access to the site can only be achieved via a public right of way (byway) 567 (b) / 568 (b) which is steep and unsuitable for use by most private cars contrary to Policies SWDP 21, and SWDP 34 of the South Worcestershire Development Plan. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; seeking further information following receipt of the application; considering the imposition of conditions In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
