| The proposal is for a cramped form of development which would fail to respect the spatial pattern of development and character of the area, resulting in overdevelopment of the site which would be harmful to the amenities of both prospective occupants of the dwellings and neighbouring properties, as well as having an unacceptable impact on trees. Furthermore, the application has failed to provide sufficient information to demonstrate that the development would not have a harmful impact on protected species and also fails to make suitable provision to meet BNG requirements. The development would therefore be contrary to Policies SWDPR01, SWDPR05, SWDPR28, SWDPR29 and SWDPR34 of the South Worcestershire Development Plan Review as well as contrary to Policies MH2, MD1 and MG3 of the Malvern Town Neighbourhood Plan. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
