| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
| No development, vegetation removal, site clearance, and excavation shall take place until a construction environmental management plan CEMP: Biodiversity) prepared by a suitably experienced and qualified ecologist has been submitted to and approved in writing by the local planning authority. The CEMP (Biodiversity) shall be informed by updated ecological surveys as appropriate, but will include the following:
a. Risk assessment of potentially damaging construction activities;
b. Identification of “biodiversity protection zones”;
c. Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during construction (may be provided as a set of method statements/mitigation strategies) and shall include a protection of surrounding habitats form run-off and pollution, and mitigation measures for amphibians, reptiles, birds and small mammals;
e. The location and timing of sensitive works to avoid harm to biodiversity features;
f. The times during construction when specialist ecologists need to be present on site to oversee works;
g. Responsible persons and lines of communication;
h. The role and responsibilities on site of an ecological clerk of works (ECoW) or similarly competent person;
i. Use of protective fences, exclusion barriers, silt management measures and warning signs.
The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority.
Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with polices SWDP 22 and SWDPR27 of the South Worcestershire Development Plan, paragraphs 187, 192 and 193 of the National Planning Policy Framework (NPPF) and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended). |
| The development hereby permitted shall be carried out in strict accordance with the recommendations set out in Section 6 of the Preliminary Ecological Appraisal report carried out by Environment Bank and dated October and submitted with this application. In particular:
The creation and 30 year long-term management and maintenance of ponds as wildlife habitats in accordance with the Habitat Management Plan (HMP) (MALV2301-EB-HMP-v01.00, Environment Bank, 2023).
Reason– To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area and to minimise impacts on protected species in accordance with local policies with SWDP22 and SWDPR27, NPPF paragraphs 187, 192 and 193 |
| No disturbance of, or change to, the surface of the path or part thereof should be carried out without our written consent.
No diminution in the width of the right of way available for use by the public. Building materials must not be stored on the right of way.
Vehicle movements and parking to be arranged so vehicles do not unreasonably interfere with the public’s use of the right of way.
No additional barriers are placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority.
The safety of the public using the right of way is to be ensured at all times.
The National Planning Policy Framework by the Ministry of Housing, Communities and Local Government, particularly paragraph 104, states that planning policies protect and enhance public rights of way and access.
The developer should also be aware of the Department of Environment Circular 1/09 (part 7) which explains that the effect of development on a public right of way is a material consideration in the determination of applications for planning permission and that the grant of planning consent does not entitle developers to obstruct a public right of way.
The Definitive Map is a minimum record of public rights of way and does not preclude the possibility that unrecorded public rights may exist, nor that higher rights may exist than those shown. |
| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
