Condition Details / Information Notes
The previous conversion of the building to habitable accommodation under planning permission 19/01818/CU was only acceptable on the basis that it was used as a holiday let in accordance with Policy SWDP35 of the South Worcestershire Development Plan and its use was limited accordingly by condition. The removal of Conditions 4 and 5 of planning approval 19/01818/CU would be tantamount to allowing a new dwelling in the open countryside. In this case, the proposed development, due to its location outside of the settlement boundaries defined within the South Worcestershire Development Plan, conflicts with the development strategy which seeks to prevent new housing in the open countryside unless it meets one of the exceptions as set out in policy SWDP2. No justification has been put forward as to how the proposal meets any of these exceptions. In this case, notwithstanding the Council's position in respect of housing land supply, the open countryside location, remoteness from facilities and reliance on the private car for everyday trips means that the core aim of sustainability is undermined and the adverse impacts of approving development in this location would significantly and demonstrably outweighs the benefits. Accordingly, the development would be contrary to Policies SWDP1, SWDP2 and SWDP4 of the South Worcestershire Development Plan and paragraph 11d of the NPPF.
Notwithstanding the above reasons for refusal, it is considered that this development is capable of providing the necessary financial contribution towards off-site affordable housing. However, a secure mechanism is not in place to secure such an obligation, and therefore the development is contrary to Policy SWDP15 of the South Worcestershire Development Plan and would fail to meet the social objectives of sustainable development as set out in the National Planning Policy Framework.
This decision notice relates to the following plan and drawing nos: 101351/TURTON/009/PL01, PL02 & PL03.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- making policies available for the public to view on the website. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
