Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents Location Plan Block Plan As Proposed DRG No – 2389-04C Plans and Elevations As Proposed DRG No – 2389-05M Reason: To define the permission.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Roost Assessment carried out by Focus Environmental Consultants dated 24 September 2024 and submitted with this application. In particular:- - A Reasonable Avoidance Measures (RAMs) Method Statement specifically for bats must be produced and adhered to during the works. This document will include such information as pre-start inspection details, specific works to be completed under supervision, methods of demolition/ refurbishment, timing and weather restrictions, and additional mitigation as required during the construction phase. - In line with Government policy on biodiversity, a single bat box should be installed within the landownership of 155 Old Hollow. The box should be integrated within the proposed or existing built structure (e.g. Integrated Eco Bat Box, Habibat bat box, Schwegler Wall-mounted Bat Shelter 2FE, PRO UK Build-in Woodstone Bat Box or Schwegler 2FR Bat Tube) or installed on the existing built structure (e.g. 1FQ Schwegler Bat Roost, 2FE Schwegler Wall-Mounted Bat Shelter). The box should be installed at least 4m above ground-level, and not placed above windows or proposed balcony areas. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2017 (as amended), the latter of which deems them a European Protected Species. It is a criminal offence to damage or destroy a roost (even if bats are not occupying the roost at the time), to deliberately kill or injure a bat, disturb a bat in its roost, or intentionally or recklessly obstruct access to a bat roost. Planning consent for a development does not provide a defence against prosecution under these acts. Any removal of roof and wall coverings including roof tiles, slates, hanging tiles, timber boarding, timber window frames, soffit boxes and facia boards shall be carried out carefully by hand. If bats or any sign of bats such as an accumulation of droppings are encountered at any stage of work, work must cease immediately and advice sought from an appropriately licenced bat ecologist on how to proceed lawfully. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: seeking amendments to the proposed development following receipt of the application. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
