Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 1115-01-P1 Location Plan and Block Plan 1115-08-P3 Existing and Proposed Block Plans 1115-20-P3 Proposed Ground Floor Plan 1115-21-P2 Proposed First Floor & Roof Plan 1115-22-P2 Proposed East Elevation 1115-23-P2 Proposed West Elevation 1115-24-P2 Proposed South Elevation 1115-25-P2 Proposed North Elevation 1115-26-P2 Proposed Cross Section 1115-27-P2 Proposed Long Section 1115-28-P2 Proposed Carport & Store Elevations Reason: To define the permission
Notwithstanding the submitted details shown on the approved plans, the final selection of external facing materials and colours for the proposed new buildings, along with an Environmental Colour Assessment (ECA) shall be submitted to and approved in writing by the Local Planning Authority. The ECA shall be used to inform the submission. Samples and/or trade descriptions of the external facing, roofing, surfacing and other materials to be used in the construction of the development hereby permitted shall be submitted prior to installation of the materials on site. The development shall be carried out in accordance with the approved details. Reason: To ensure the satisfactory appearance of the development in accordance with Policies SWDP 21, 23 and 25 of the South Worcestershire Development Plan and relevant guidance found in the Malvern Hills AONB publication entitled ‘Guidance on the Selection and Use of Colour in Development’
Prior to its installation on site as part of the development hereby approved, a Specification of the green roof covering , to include details of the species mix and planting numbers and position, as well as maintenance schedule shall be submitted to the local authority for approval. The green roof shall be installed fully in accordance with the agreed specification and shall be maintained thereafter in accordance with the maintenance plan. Reason: To ensure the satisfactory appearance of the development in accordance with Policies SWDP 21, 23 and 25 of the South Worcestershire Development Plan and relevant guidance found in the Malvern Hills AONB publication entitled ‘Guidance on the Selection and Use of Colour in Development’
Before the first use or occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first use/occupation of the development hereby permitted or in accordance with a timetable agreed in writing by the local planning authority. Development shall be carried out in accordance with the approved details. Reason: To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan
Before the first use/occupation of the development hereby permitted a scheme of soft and hard landscaping, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include:- (i) a plan(s) showing details of all surfacing, existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting, surfacing and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) details of any new surfacing materials. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21, SWDP23 and SWDP25 of South Worcestershire Development Plan
No external lighting shall be installed without firstly receiving agreement in writing with the Local Planning Authority. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21, SWDP23 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan
Prior to the commencement of development, an arboricultural method statement (AMS) shall be provided to the local planning authority. The AMS will describe the process of construction where it impacts upon retained trees, and shall be in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction). Development shall proceed in accordance with the approved document. Reason: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.
No construction works of any type should take place, including site clearance, demolition, or site stripping (includes archaeological investigation) until a site meeting has taken place between the applicant, their chosen contractor and the council’s tree and landscape officer. Reason: In order to ensure that the requirements of the approved tree protection measures are clearly understood by all parties involved in the construction process and to prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality in accordance with policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development shall take place in accordance with the measures set out within the Phase 1 Preliminary Ecological Appraisal, competed by Europaeus Land Management Services (Ecology) dated June 2022. dated 30/09/2024, in particular: • Works to take place under a European Protected Species Mitigation Licence • The installation of one bird and one bat box. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22 of the South Worcestershire Development and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 (as amended).
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.
The applicant must be aware of their obligations towards the public right of way as follows: No disturbance of, or change to, the surface of the path or part thereof should be carried out without written consent (this includes laying concrete, tarmac or similar) No diminution in the width of the right of way available for use by the public. Building materials must not be stored on the right of way. Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public's use of the right of way. No additional barriers are placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority. The safety of the public using the right of way is to be ensured at all times.

Prior to carrying out works, please register on www.linesearchbeforeudig.co.uk to submit details of the planned works for review, ensuring requirements are adhered to. The original holding objection was triggered due to the presence of a High-Pressure Major Accident Hazard Pipeline (MAHP). The minimum building proximity distance (BPD) for the pipelines and associated installations is as follows: • Specific HP metre BPD 14 metres The building proximity distance taken from The Institution of Gas Engineers and Managers publication IGEM/TD/1 Edition 5 which is the standard applicable to steel pipelines and associated installations for high pressure gas transmission and IGEM/TD/3 Edition 5 Steel and PE pipelines for gas distribution.
