| The creation of a pond in the proposed location is considered to be inappropriate to the site context and would negatively impact the way in which the listed building, and its historical context as a moated farmstead, is read and understood. This would cause less than substantial harm to the setting and significance setting of the listed building. Furthermore, further excavations to complete the development would likely truncate the original moat and negatively impact the heritage asset in a manner that archaeological investigation could not mitigate. In accordance with Paragraph 215 of the NPPF, there would be some public benefit of the pond in providing biodiversity enhancements however, this benefit would be minimal given the scale of the development and is not considered to outweigh the harm caused to the heritage assets. The proposal would not preserve the character of the host building and its significance as a designated heritage asset as well as the archaeological significance of the site. As such it would not accord with the conservation aims of policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan 2016 (SWDP). The proposal is also not considered to meet the requirements of the National Planning Policy Framework including chapters 12 and 16 as well as Section 66 of the Planning (Listed Buildings and Conservation Areas) Act 1990. |

| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
