Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out in accordance with the following plans: D0 - Location Plan; D2 - Proposed Site Plan; D3 - Proposed Floor Plan; D4 - Proposed Elevations 1; D5 - Proposed Elevations 2. Reason: To define the permission.
The proposed dwellings shall be finished in the external materials as listed below unless otherwise agreed in writing with the Local Planning Authority: Walls: - Stonework Facing Masonry Roof: - Slate Tile The development shall be carried out using the materials as approved. Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays. Reason: To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Biodiversity Enhancement Strategy, Bat Survey Report and Preliminary Ecological Appraisal with Preliminary Roost Assessment carried out by Focus Environmental Consultants submitted with this application. In particular:- - The planting of three, new native trees within the wider garden; - Inclusion of one in-built bat box installed on the external wall; - Erection of two traditional bird boxes within the land ownership providing new nesting opportunities for birds; - A post developed site visit undertaken by a competent ecologist to sign off the completion of the ecological enhancement measures. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in accordance with the details provided in the Focus Environmental Consultants BS5837:2012 Arboricultural Survey & Preliminary Impact Assessment. Reason: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and policies MD1 and MD2 of the Malvern Town Neighbourhood Plan.
The development hereby permitted shall not be occupied/first used until full details of all surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
No development above ground level shall take place until details of the renewable and/or low carbon energy generation measures, including drawings showing the design and position of the proposed measures at a scale of 1:50, shall have been submitted to and approved in writing by the local planning authority. The development shall be carried out in accordance with the approved details. Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan.
Prior to first occupation of the dwelling herby approved, details to demonstrate that the predicted non recycled water consumption of the property will be no more than 110 litres per day per person shall be submitted in writing to the Local Planning Authority for approval. Reason: To mitigate the impacts of climate change in accordance with policy SWDP30 of the South Worcestershire Development Plan.
Within 6 months from the date of first occupation of the approved dwellings the properties shall be connected to super-fast broadband. Reason: To ensure the development is in accordance with Policy SWDP26 of the South Worcestershire Development Plan.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
