Condition Details / Information Notes
As a result of the extent of the accommodation (3 bedrooms, 2 bathrooms, kitchen/living room, office and store) and detached and seperated nature of the development, the retrospective building could viably operate as a self-contained independent dwelling with no alterations. As such the self-contained nature of the builing fails to demonstrate a clear dependency upon its host dwelling. The applicant has also failed to provide information or justification for the level of accommodation provided and who would occupy the annexe building. The application site lies beyond the development boundary and in an area of open countryside. Policy SWDP2 seeks to strictly control new development in the open countryside to development listed at SWDP2C, none of which apply in this case (dwellings for rural workers, rural employment development, rural exception sites, buildings for agriculture and forestry, replacement dwellings, house extensions, replacement buildings and renewable energy projects plus development specifically permitted by other SWDP policies). Whilst planning permission would be required to regularise the use of the building as an independent dwelling, the South Worcestershire Design Guide SPD makes it clear that outbuildings that do not demonstrate reliance upon the main dwelling should be resisted, especially within open countryside locations. Therefore the proposal would fail to accord with policies SWDP2 and SWDP21 of the South Worcestershire Development Plan and the South Worcestershire Design Guide Supplementary Planning Document (March 2018).

In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately the submitted application is not considered to accord with the advice available nor was pre-application advice sought prior to its submission. As a result the Council has been unable to seek solutions to problems arising from this application as the amendments required to make the application acceptable are substantial and are considered to materially change the development proposals. They would require further consultation to be undertaken prior to determination which could not take place within the statutory determination period specified by the Ministry of Housing, Communities & Local Government. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice.
