| Due to the siting and layout, the proposal would introduce a new pattern of development within this area of Powick village which is predominantly characterised by dwellings within rows fronting the highway and street frontage as opposed to a cul de sac/courtyard arrangement. The proposal would relate poorly to the existing settlement pattern and would fail to integrate within this part of Powick Village residential streetscene, creating an alien and incongruous form of development. In addition, whilst the layout of the proposed dwellings are for indicative purposes only, this still demonstrates that the proposal would fail to maintain the spacious character of the area, appearing cramped and causing overdevelopment of the site. Therefore, the proposal would not represent high quality design that would integrate effectively with its surroundings contrary to Policy SWDP21 of the South Worcestershire Development Plan (February 2016), the principles of the Design Guide SPD and the provisions of the National Planning Policy Framework (2023), particularly Section 12 which states that new development should be of high quality design and contribute positively to making places better. |
| The position of the site relative to the dwellings fronting Old Malvern Road siting of the development would result in the loss of private outdoor amenity area serving the property Wytchfields and due to overlooking of the garden area to the front of the property directly facing onto the street at Malvern Road, this would result in such a loss of private outdoor amenity that it would to the detriment of occupiers of this property. In addition, due to siting of the proposed residential use, this would also result in the introduction of a vehicular access entrance and increase in traffic movements in close proximity to nearby residential properties that would exacerbate noise and nuisance to occupiers of these properties over what is currently experienced to the detriment of their health and well being. As such the land use would not be appropriate for additional residential development and would be contrary to Policies SWDP21 and SWDP31 of the Development Plan, the principles of the Design Guide SPD and the provisions of the National Planning Policy Framework (Dec 2023) in particular paragraph 135 which states that planning decisions should have a high standard of amenity for existing and future users. |

| In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the applicant has failed to provide a scheme that would comply with the statutory policies of the development plan and would not overcome the reasons for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice. |
