Condition Details / Information Notes
By virtue of its position and flat roof design, the proposed front extension would harmfully detract from the street scale and fail to respect the character of the host property, furthermore the proposed garage by reason of its design, scale and position would result in development would appear harmfully incongruous and prominent within the streetscene and detract from the quality of the wider settlement character and Malvern Hills National Landscape. As such, the proposal would fail to integrate into the setting and result in an alien addition to the locality. The proposal is therefore considered to be contrary to policies SWDP21, SWDP23 and SWDP25 of the South Worcestershire Development Plan, the South Worcestershire Design Guide SPD Part 1: Overarching Design Principles and also contrary to the National Planning Policy Framework paragraph 135 and guidance from the Malvern Hills National Landscape Team
The position of the proposed garage is such that the development would result in the loss of an existing parking area and the displacement of 2 cars onto the highway, creating additional congestion and reduced visibility for highways users, cyclists and pedestrians. Furthermore the proposal will create the potential for waiting vehicles to stop on the live carriageway waiting for garage doors to open, which will create a hazard and safety risk within the highway. In view of this the proposal is considered contrary to paragraph 114) Paragraph as well as policies SWDP4 and SWDP 21 of the South Worcestershire Development Plan and the WCC Streetscape Design Guide (SDG).
In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately, the submitted application is not considered to accord with policy. As a result, the Council has been unable to seek solutions to problems arising from this application as the amendments and additional information required to make the application acceptable are substantial and would be required to be submitted as a new planning application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice.
