Condition Details / Information Notes
The applicant has failed to provide sufficient information as to why a new access is required when there is an existing access in place which is currently clearly in use for agricultural purposes. As such at present the applicant has failed to demonstrate that there would be a clear need for the proposal in terms of agricultural use to justify development in the open countryside to comply with Policy SWDP2C of the South Worcestershire Development Plan (2016).
The development requires the creation of visibility splays of 2.4m x 160.7m to the east, and 2.4m x 152.5m to the west. The Transport Statement indicates that minimal hedge removal would be required, however the hedgerow is close to the carriageway edge near to the access point and the application does not demonstrate the amount of hedgerow that would have to be removed to achieve the requisite visibility and it is likely to be significantly more than anticipated in the preliminary ecology report. The loss of hedgerow would have a significant negative impact on the visual amenity and landscape character of the area as well as leading to a loss of green infrastructure and priority habitat and a potential impact on protected species contrary to Policies SWDP 5, SWDP 21, SWDP 22, SWDP 25 and the NPPF paragraph 186.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- seeking further information following receipt of the application. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
This decision notice relates to the following plan and drawing nos: Location plan L01 Rev E, Visibility Splay Plan 25488 01, tracking Plan 25488-02, Gate Detail drawing PA 01.
