| The specified visibility splays required could not be achieved and would be obstructed by neighbouring land, outside of the applicants ownership. As such, the proposal fails to provide suitable visibility from a new access onto a classified road and would have an unacceptable impact upon highways safety. The application is found contrary to policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan (February 2016), as well as paragraph 115 and 116 of The Framework and the Adopted Worcestershire Highways Design Guide. |
| The application has failed to provide adequate details to demonstrate that site drainage and runoff would be managed in a suitable and co-ordinated way that mimics the natural drainage network. Without this information the proposal therefore fails to demonstrate that it would accord with policy SWDP29 of the South Worcestershire Development Plan. |
| In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately, the submitted application is not considered to accord with policy. As a result, the Council has been unable to seek solutions to problems arising from this application as the amendments and additional information required to make the application acceptable are substantial and would be required to be submitted as a new planning application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application |
