Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out in accordance with the following plans: - PL001 Rev. A - PL007 - PL009 - PL010 - PL008 - PL006 - PL003 Rev. D Reason: To define the permission.
The Development hereby permitted shall not be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards.
The Development hereby approved shall not commence until a Construction Environmental Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:- • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway; • Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc); • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring. • Details of any temporary construction accesses and their reinstatement. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the local planning authority. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety.
The Development hereby approved shall not be brought into use until the access, parking and turning facilities have been provided as shown on drawing SK003 Rev C – Proposed Site Plan. Reason: To ensure conformity with submitted details.
The development hereby permitted shall not be occupied/first used until full details of all surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with recommendations set out in the Recommendation section (pgs 19-21) of the Preliminary Ecological Appraisal report produced by Katie Warren dated June 2024 and submitted with this application. In particular: - Reasonable Avoidance Measures for herpetofauna including great-crested newts including supervision from a qualified ecologist; - Reasonable Avoidance Measures for mammals; - Ensuring that nesting birds are not disturbed during clearance works; - Any new lighting must be wildlife sensitive and avoid illuminating hedgerows; - Enhancement for protected species to include bird, and bat boxes, a hedgehog gaps in fences and reptile and amphibian refugia/log piles. Reason: to ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22 of the South Worcestershire Development and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended).
The approved Biodiversity Gain Plan shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Landscape and Environmental Management Plan (LEMP) Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan.
The development shall not commence until a Landscape and Environmental Management Plan (LEMP), has been prepared in accordance with the approved Biodiversity Gain Plan and submitted to and approved in writing by the Local Planning Authority. It shall include: (a) a non-technical summary; (b) the roles and responsibilities of the people or organisation(s) delivering the LEMP; (c) the planned habitat creation and enhancement works, including planting specifications, to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan; (d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and (e) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority, Notice in writing shall be given to the Council when the habitat creation and enhancement works as set out in the LEMP have been completed. The created and enhanced habitat specified in the approved LEMP shall thereafter be managed and maintained in accordance with the approved LEMP. Monitoring reports shall be submitted to the local planning authority in writing in accordance with the methodology and frequency specified in the approved LEMP. The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the LEMP are not being met, how contingencies and/or remedial action are identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. Reason: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in accordance with the details provided in the Origin Environmental Arboriculture BS5837:2012 Arboricultural Impact Assessment. Reason: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and policies MD1 and MD2 of the Malvern Town Neighbourhood Plan.
Prior to first occupation of the dwelling herby approved, details to demonstrate that the predicted non recycled water consumption of the property will be no more than 110 litres per day per person shall be submitted in writing to the Local Planning Authority for approval. Reason: To mitigate the impacts of climate change in accordance with policy SWDP30 of the South Worcestershire Development Plan.
Demolition, clearance, or construction works, including construction deliveries, shall take place only between 08:00 and 18:00 on Monday to Friday and between 08:00 and 13:00 on Saturday and shall not take place at any time on Sundays or on Bank or Public Holidays. Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
