Condition Details / Information Notes
The application site is located in the open countryside where sustainable travel choices are limited. Residents, employees and visitors would be highly reliant on the motor vehicle to get to and from the site, and due to the working activity taking place off-site would severely reduce the positive benefits that lay behind the policy objectives of securing reduced travel. Furthermore, as the site is poorly related to local services, this would increase the need for journeys to be made by the private motor vehicle. As such the proposal would not be sustainable in terms of location and is contrary to Policies SWDP1, SWDP2, SWDP4 and SWDP8 of the South Worcestershire Development Plan and the provisions of the National Planning Policy Framework, Chapter 9, particularly paragraph 114 that require development to minimise the demand for travel and offer genuinely sustainable travel choices.
The proposed live-work unit would, by reason of its height, intended use and appearance introduce a discordant and quasi-industrial use in the open countryside. When taken together with the proposed 100 metre long access track crossing the field from the new access, the development would not integrate effectively with the surrounding rural landscape and would result in harm to the character and appearance of the area. Accordingly the proposal would be contrary to Policies SWDP12(D) SWDP 21 and SWDP 25 of the South Worcestershire Development Plan and the National Planning Policy Framework (NPPF).
The proposed new access has substandard visibility available in each direction and in the absence of a speed survey, insufficient information has been provided to demonstrate that a safe access can be achieved. This risk would be further compounded due to its proximity to the existing access to The Pollards, the types of vehicles intending to use it, and its proposed location on Station Road with has blind bends in each direction. As such, presents an unacceptable risk to highway safety and accordingly the development fails to accord with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan and paragraph 114 of the National Planning Policy Framework.
The proposed development would, by reason of the nature of the proposed use (Agricultural vehicle and machinery repair), its proximity to existing residential properties and associated vehicle movements, result in noise nuisance to those receptors. The applicant's proposal is not informed by a noise assessment and fails to consider whether any appropriate mitigation could be undertaken to address the likely adverse impact and consequent loss of residential amenity arising from the proposed use. Accordingly, the proposal is contrary to Policies SWDP31 (A) of the South Worcestershire Development Plan (adopted 2016) and paragraph 191 of the NPPF.
The details submitted in support of the application are insufficient to allow an archaeological impact determination to be made. Currently it is not possible to determine the impact of this application upon the historic environment, the application is therefore not in accordance with paragraphs 200 and 211 of the NPPF or with SWDP 6 and 24 of the South Worcestershire Development Plan 2016 (as amended)
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways- making Development Plan Policy and Design guides available for public viewing. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
