Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 8424-09 Proposed Location Plan 8424-10A Proposed Ground & First Floor 8424-11A Proposed 1.5 & Roof Plan 8424-12A Proposed SE & NE Elevation 8424-13A Proposed NW & SW Elevation 8424-14A Proposed Section 1 8424-15A Proposed Section 2 8424-16A Proposed Section 3 Design Access and Heritage Statement -- Rev A Reason: To define the permission.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Bat Roost Assessment Survey Report undertaken by Aware Ecology Ltd dated 24/07/2024 and submitted with this application. In particular the details as fully outlined within section 4.5 Mitigation/Avoidance Measure set out within the report, which include:- -A bat box should be fitted to an appropriate location before work commences. This will provide provisional roosting space for any bats encountered during the works - All contractors working on the proposed development must be briefed by a licenced ecologist (Aware Ecology 07470433712) on the legal protection afforded to protected species and their places of shelter and on how to proceed if anything is discovered during the work - Bats will likely be flying around the buildings at night during the late spring, summer, and early autumn months, and they could investigate any new crevices or cavities that are exposed on the walls/roof during the building works. Any such holes or gaps must be securely covered/blocked at the end of each day’s work to prevent bats from having the opportunity to use them for shelter. - In the unlikely event that a bat is encountered, work in that area must STOP immediately, and advice must be sought from a licenced bat ecologist before resuming. - erection of two artificial bird boxes, one house martin box, one house sparrow box and two bat boxes on suitable features at the perimeter of the site or on the buildings themselves. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Lower Hill Top. The development shall not be used as an independent self contained dwelling separate from the dwelling known as Lower Hill Top. Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
Buildings are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and Natural England must be contacted on 0845 6003078 for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the relevant contact details.
